AN ORDINANCE AMENDING CHAPTER 18, PERSONNEL, OF THE CITY OF
GEORGETOWN CODE OF ORDINANCES BY ADDING SECTIONS 18-8
THROUGH 18-12 TO PROVIDE FOR PARTICIPATION IN THE TEXAS
MUNICIPAL RETIREMENT SYSTEM AND THE SUPPLEMENTAL DEATH
BENEFITS FUND BY THE CITY OF GEORGETOWN TEXAS; PROVIDING A
SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE
WHEREAS,
amended
Municipal
Subtitle G of Title 110B, Revised Civil
(hereinafter referred to as the
Retirement System, authorizes the
Statutes
"TMRS Act"),
governing body
of Texas,
relating
of each
1925, as
to the Texas
city or town
to elect,
at its option, to have one
or more of
the city
departments
participate in such System; and
WHEREAS, the City Council
of
the City of Georgetown,
Texas, has previously
adopted an ordinance
dated
February 9, 1959 and an
amending ordinance dated
May 9, 1966, that found
that
it is in the public interest
for the city to have
its employees participate

WHEREAS, such February 9, 1959
ordinance and
May 9, 1966 Ordinance are
hereafter referred
to as the "Prior
Ordinances";
hereby
NOW THEREFORE, BE
IT ORDAINED BY
THE CITY COUNCIL
OF THE CITY OF GEORGETOWN:
SECTION 1. That
Chapter 18,
Personnel, of
the City Code of Ordinances be
amended by adding
departments
sections 18-8
through
18-12
as
follows:

The City
Council of
the
City of Georgetown, Texas, on
behalf of said
City,
hereby
exercises its
option and
elects
to have
the City
and
all of the
employees
of all
departments
now existing
and those
hereafter
created
participate
in the
Texas
Municipal
Retirement
System
provided in
the TMRS
Act.
Section 18-9. Same, Notice to Board of Trustees.
The City Manager is hereby directed to notify the Board of
Trustees of the Texas Municipal Retirement System that the
City has elected to participate and have the employees of
the city covered in said System.
Section 18-10. Same, Employee Eligibility.
Each person who becomes an employee of a participating city
on or after the effective date of participation of such
city whose position shall require more than 1,000 hours
per year shall become a member of the Texas Municipal
Retire System as a condition of such person's employment.

Section 18-I1. Same, Deposits.
In accordance with the provisions of the TMRS Act, the
deposits to be made to the Texas Municipal Retirement
System on account of current service of the employees of
the several participating departments are hereby fixed at
the rate of five percent (5%) of the full earnings of each
employee of said departments.
Section 1-12. Same, Remittance to the Texas Municipal
Retirement System,
The
City Manager is hereby
directed to
remit to the Board
of
Trustees of
the Texas
Municipal
Retirement System, at
its
office in Austin,
Texas,
the City's
contributions to
the
System and the
amounts
which shall
be deducted from the
compensation or payroll of employees, all as required by
said Board under the provisions of Title 110B, VACS,
(hereafter the "TMRS Act") as amended, and the said City
Manager is hereby authorized and directed to ascertain and
certify officially on behalf of the City, the prior
service rendered to the said municipality of each of the
employees of the several participating departments, and the
average prior service compensation received by each, and to
make and execute all prior service certifications and all
other reports and certifications which may be required of
the City, under the TMRS Act as amended, or in compliance
with the rules and regulations of the Board of Trustees of
the Texas Municipal Retirement System,
SECTION 2. If any section, paragraph, clause, phrase, or provision of this
Ordinance shall be adjudged invalid or held unconstitutional, the same shall
not affect the validity of this Ordinance as a whole or any part or provision
thereof other than the part so declared to be invalid or unconstitutional.
SECTION 3. The Council additionally ratifies and adopts, as its own act and
deed, any prior acts of City Officials relating to the inclusion within TMRS
participation of any other City departments and employees thereof who were not
specifically enumerated in the Prior Ordinances,
SECTION 4.
This
ordinance
is intended to amend the Prior Ordinances.
In
the
event any
conflict
may
now or hereafter exist between this ordinance
and
the
Prior Ordinances,
the terms
of this ordinance shall prevail.
SECTION 5.
This
ordinance
shall become effective upon the first day
of
the
calendar
month
following
its adoption on second and final reading
by
the
City Council of the City of Georgetown, Texas.
