HomeMy WebLinkAboutORD 870449.009 - Chap 9 Court & CriminalORDINANCE NUMBER 870449.009 AN ORDINANCE AMENDING CHAPTER 9, COURT AND CRIMINAL PROCEDURE, OF THE CITY OF GEORGETOWN CODE OF ORDINANCES, SECTION 9-9. FINES AND SPECIAL EXPENSES, TO LEVY A SPECIAL EXPENSE NOT TO EXCEED $10.00 FOR DISMISSED CASES; PROVIDING A SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN: SECTION 1. That Chapter 9, court and Criminal Procedures, of the City of Georgetown Code of Ordinances, section 9-9, Fines and special expenses, is hereby amended to read as follows: All fines and special expenses imposed by said court in any prosecution therein shall be paid into the city treasury for the use and benefit of the city. The court shall collect a special expense not to exceed ten dollars ($10.00) for services performed in cases in which the laws of this State require the case be dismissed because of actions by, or on, behalf of the defendant which were subsequent to the date of the alleged offense. In all cases the judge may waive any special expenses and assess the penalty in any case by a fine only. (State law reference VACCP art 45.06; VACS art. 6701d) SECTION 2. If any section, paragraph, clause, phrase, or provision of this Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so declared to be invalid or unconstitutional. SECTION 3. This ordinance shall become effective upon adoption of its second and final reading by the City Council of the City of Georgetown, Texas and its publication. Read on first reading this 8th day of September 1987. Read and adopted on second reading this 28th day of September 1987.
