AN ORDINANCE VACATING AND ABANDONING THAT
PORTION OF THE OAK LANE RIGHT OF WAY BETWEEN
LOTS 6 AND 7 BLOCK 4 CRESTVIEW ADDITION UNIT
TWO, AS RECORDED IN CABINET A, SLIDES
340-341 OF THE PLA': RECORDS OF WILLIAMSON
COUNTY, TEXAS AND LOTS 8 AND 10, BLOCK ONE,
CRESTVIEW ADDITION UNIT THREE, AS RECORDED
IN CABINET B, SLIDES 88-89 OF THE PLAT
RECORDS OF WILLIAMSON COUNTY, TEXAS,
AND EXCEPTING AND RESERVING UNTO THE CITY OF
GEORGETOWN, ITS SUCCESSORS AND ASSIGNS THE
ABANDONED PORTION OF THE RIGHT OF WAY WHERE
THERE ARE ANY FUNCTIONING UTILITY LINES OR
APPURTENANCES LOCATED IN, ON OR UNDER SAID
ABANDONED PORTION FOR THE PURPOSE OF
REPAIRING, REPLACING, RESTORING, REMOVING,
RELOCATING, AND MAINTAINING AS MAY BE
NECESSARY FROM TIME TO TIME EXISTING
UTILITY LINES, INCLUDING SEWER, DRAINAGE,
WATER PIPING AND ELECTRIC DISTRIBUTION
LINES AND APPURTENANCES ON, UNDER, ACROSS
WHEREAS, the City of
Georgetown
abandoned a portion of the
Oak Lane right of way located
north of
Ranch Road by
the passage
of Ordinance #80-7 on
April 8,1980,
and by Quit
Claim Deed,
recorded in Volume 796,
Page 747
of the Deed
Records of
Williamson County, Texas,
which deeded
the abandoned
right of way
to the
Crestview Baptist Church;
and
WHEREAS, it was
the
intention of
the
City to abandon and
Quit Claim Deed only
the
northernmost
0.25
acre portion of the
said portion of the
Oak
Lane right of
way;
and
WHEREAS, an error
Ordinance #80-7 and in
ing the portion of the

the aforementioned Quit Claim Deed regard -
said Oak Lane right of way that was in -
by the City and deeded to the Crestview
WHEREAS, the Crestview
Baptist
Church, which
adjoins the
aforementioned Oak Lane right
of way,
has petitioned
the City of
Georgetown to correct the previous abandonment
error
and abandon
only that 0®25 acre portion
of the
said Oak Lane
right of way
that was originally intended
to be
abandoned, as
is shown on
Exhibit "A" attached; and
WHEREAS, the Crestview Baptist Church has, by Quit Claim
Deed, returned to the City of Georgetown, a 0.16 acre portion of
the said Oak Lane right of way that acquired from the City in the
aforementioned Quit Claim Deed that was prepared in error; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS;
Section One. All of the facts recited in the preamble to
this ordinance are hereby found by the Council to be true and
correct, and are incorporated by reference herein and expressly
made a part hereof, as if copied herein verbatim;
Section Two® The City hereby abandons and vacates that
portion of the Oak Lane street right of way located BETWEEN LOTS
6 AND 7 BLOCK 4 CRESTVIEW ADDITION UNIT TWO, AS RECORDED IN
CABINET Al SLIDES 340-341 OF THE PLAT RECORDS OF WILLIAMSON
COUNTY, TEXAS AND LOTS 8 AND 10, BLOCK ONE, CRESTVIEW ADDITION
UNIT THREE, AS RECORDED IN CABINET B, SLIDE 88-89 OF THE PLAT
RECORDS OF WILLIAMSON COUNTY, BEING THAT 0.25 ACRE PARCEL OF LAND
MORE PARTICULARLY DESCRIBED IN EXHIBIT "A",? ATTACHED HERETO AND
INCORPORATED HEREIN BY REFERENCE FOR ALL PURPOSES, and excepting
and reserving unto the City of Georgetown, its successors and
assigns the abandoned portion of the right of way where there are
any functioning utility lines or appurtenances located in,
across, on or under said abandoned portion for the purpose of
repairing, replacing, restoring, removing, relocating, and
maintaining as may be necessary from time to time utility lines,
including sewer, drainage, water piping and electric distribution
lines and appurtenances on, under, across or over said abandoned
portion.
Section Three. It is the intention of the City in
correcting the previous erroneous abandonment described herein to
reinstate or "unabandon" that certain 0.16 acre portion of the
Oak Lane right of way, being more particularly described in
Exhibit B attached hereto and incorporated herein by reference
for all purposes as the "Reinstated Tract". Further to evidence
this intent, Crestview Baptist Church has covenanted to submit
itself and additionally to secure from landowners adjoining this
"Reinstated Tract", Quit Claim Deeds conveying to the City all
adjoining landowners' interest in this "Reinstated Tract".
