HomeMy WebLinkAboutORD 870407 - ANX of 251.3 AcresAN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF GEORGETOWN, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY CONSISTING OF: 251.3 ACRES INCLUDING THE LAND BETWEEN IH -35, THE SOUTH CITY LIMITS AND THE CITY LIMITS ALONG THE EAST SIDE OF U.S. HWY. 81 SOUTH OF THE CITY; THE LAND BETWEEN THE EAST RIGHT-OF-WAY OF U.S. HWY. 81, THE EAST RIGHT-OF-WAY OF IH -35 AND THE CURRENT NORTHERN CITY LIMITS, AND THE LAND INCLUDED IN THE DENNIS P. MCCOY SUBDIVISION AND A 500 FT. WIDE STRIP EXTENDING FROM SAID SUBDIVISION NORTHWARD ALONG THE EAST RIGHT-OF-WAY OF IH -35 AND U.S. HWY. 81 TO THE SOUTHERN CITY LIMITS; WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMIT OF THE CITY OF GEORGETOWN, TEXAS AND NOT BEING PART OF ANY INCORPORATED AREA; PROVIDING FOR SERVICE PLANS, AND CONTAINING A SAVINGS CLAUSE. WHEREAS, the City Council of the City of Georgetown, Texas, may under the Charter of said City, Section 1.06, annex areas as allowed by State law, and WHEREAS, notices of two (2) public hearings were published according to law in a newspaper having general circulation in the City of Georgetown, Texas, and in the herein described territory to be annexed not more than 20 days nor less than 10 days prior to those hearings; and WHEREAS, two public hearings by the City Council of the City of Georgetown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of certain tracts of land located in Williamson County, Texas, including THE LAND BETWEEN IH -35, THE SOUTH CITY LIMITS AND THE CITY LIMITS ALONG THE EAST SIDE OF U.S. HWY. 81 SOUTH OF THE CITY; THE LAND BETWEEN THE EAST RIGHT-OF-WAY OF U.S. HWY. 81, THE EAST RIGHT-OF-WAY OF IH -35 AND THE CURRENT NORTHERN CITY LIMITS; AND THE LAND INCLUDED IN THE DENNIS P. MCCOY SUBDIVISION AND A 500 FT. WIDE STRIP EXTENDING FROM SAID SUBDIVISION NORTHWARD ALONG THE EAST RIGHT-OF-WAY OF IH -35 AND U.S. HWY. 81 TO THE SOUTHERN CITY LIMITS; were held, the first being on the 21st day of July, 1987, and the second hearing being on the 28th day of July, 1987; and WHEREAS, at such public hearings, a proposed service plan was presented to and discussed by the Council and all interested persons, and WHEREAS, such public hearings were held not more than forty (40) nor less than (20) days prior to the institution of these proceedings: and PSF 87Anxl4.FW2 WHEREAS, the total corporate area of the City of Georgetown, Texas on the 1st day of January, 1987 was 6839 acres; and WHEREAS, the population of the City of Georgetown, Texas includes approximately 16,000 inhabitants; and WHEREAS, all the herein described territory lies within the extra -territorial jurisdiction of the City of Georgetown, Texas; and WHEREAS, the herein described territory lies adjacent and contiguous to the City of Georgetown, hereby Texas; and taxes levied WHEREAS, the herein described territory contains 251.3 acres, and is not located within the incorporated limits of another City, or within the extra -territorial jurisdiction of another City; and WHEREAS, all notices and other prerequisites of state law and the City Charter have been complied with; now therefore BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS; Section 1. All of the facts recited in the preamble to this ordinance are hereby found by the Council to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied herein verbatim; Section 2. The following described land and territory lying adjacent and contiguous to the City of Georgetown, Texas is hereby added and annexed to the City of Georgetown, Texas and said territory hereinafter described shall hereafter be included in the boundary limits of the City of Georgetown, Texas and the present boundary limits of said City at the various points contiguous to the area hereinafter described are altered and amended so as to include said area within the corporate limits of the City of Georgetown, Texas, to -wit: BEING those certain tracts and parcels of land described in Exhibit A attached hereto and in- corporated herein by reference for all purposes. Section 3. The above described territory and the area so annexed shall be a part of the City of Georgetown, Texas and the property so added hereby shall bear its pro -rata share of the taxes levied by the City of Georgetown, Texas and inhabitants thereof shall be entitled to all the rights and privileges of city citizenship, shall be bound by all such duties of citizenship and shall be bound by the acts, ordinances, resolutions and regulations of the City of Georgetown, Texas; furthermore, said tracts described in Exhibit A shall be served PSF 87Anxl4.FW2 in accordance with the service plan described in Exhibit B attached hereto and incorporated by reference herein, which is hereby approved and adopted. Section 4. If any section, paragraph, clause, phrase, or provision of this Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so declared to be invalid or unconstitutional. WIDE STRIP EXTENDING FROM SAID SUBDIVISION NORTHWARD ALONG THE EAST RIGHT-OF-WAY OF IH -35 AND U.S. HWY. 81 TO THE SOUTHERN CITY LIMITS Police Protection Upon annexation the Georgetown Police Department will provide regular and routine patrols along streets in the area as a part of its overall patrol activities. The department will respond to calls for assistance within their responsibility and jurisdiction. The City Code Enforcement Officer shall periodically patrol streets in the area to ensure that all properties are in conformance with City Code. Fire Service Fire service is now being provided to the area and will continue to be provided by the present personnel and equipment of the fire fighting force. Water Service Much of this area is developed without adequate fire protection; the City will extend water lines sufficient to provide fire protection to currently developed properties through the creation of an improvement district or some similar financing technique. Maintenance of City water facilities will be provided in accordance with rates, terms, and conditions contained in the City Code. Sewer Service Current use of septic systems shall be allowed to continue until such time as an adequately sized main in the City's organized collection system is extended to within 200 feet of the property. Refuse Collection Service will be provided in accordance with rates, terms and conditions contained in the City Code. Inspection Services All inspection services (for example building, electrical, plumbing, etc.) provided by the City will be extended to this area on the effective date of annexation. Planning and Zoning The Planning and Zoning jurisdiction of the City will extend to this area on the effective date of annexation. The zoning will be R -S (Residential Single Family) unless requested other- wise and approved through regular procedures. Streets, Street Lighting Where City of Georgetown electric service is provided, street lighting will be provided by the City at all intersections and at regular intervals on long blocks. Streets will be maintained according to City Code and policy. Recreation, Library Services Recreation and library services will be provided in accordance with rates, terms and conditions contained in the City Code. Miscellaneous Any other applicable municipal services will be provided to the area in accordance with policies established by the City.
