HomeMy WebLinkAboutORD 870391.002 - Hotel Motel Occupancy TaxORDINANCE NUMBER 870391.002 AN ORDINANCE AMENDING CHAPTER 2, ADMINISTRATION, OF THE CITY OF GEORGETOWN CODE OF ORDINANCES BY ADDING SECTIONS 2-28 THROUGH 2-31; AUTHORIZING THE CREATION OF A BOARD "THE GEORGETOWN TOURISM DEVELOPMENT BOARD," TO ADVISE THE CITY COUNCIL ON THE EXPENDITURES OF CITY OF GEORGETOWN HOTEL/MOTEL OCCUPANCY TAX REVENUES; TO SEEK FUNDS FROM GRANTS AND AGENCIES; AND TO PROMOTE TOURISM, CONVENTION ACTIVITY, AND HISTORICAL AND CULTURAL ACTIVITY; PROVIDING A SEVERABILITY CLAUSE; AND SETTING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Georgetown, Texas, in order to promote tourism and in order to encourage cultural and historical appreciation in this community for its economic and social well being, deems it in the City's best interest to create the Georgetown Tourism Development Board (as an adjunct of the City Council) to advise the City on the expenditure of certain tourism related revenue, and assist in seeking additional funds to promote tourism in attract visitors to the attractions, cultural events, our community; therefore and facilities designed to BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN: SECTION 1. That Chapter 2, Administration, to increase of the City of Georgetown Code of Ordinances be amended by adding the local convention activity; following groups and provisions: individuals; Promoting 2.28 Definitions "To encourage tourism in the Georgetown community" includes but is not limited to: Developing programs to increase community awareness of the value of tourism; Promoting named local convention activity; Promoting guided -tour groups and day -visit opportunities for individuals; Promoting existing the and developing additional community events, historical activity which may attract visitors to the attractions, cultural events, and athletic activities to and facilities designed to bring visitors to Georgetown; convention and Developing and maintaining signage to inform the public of significant local programs, historical sites, parks, and related information. 2.29 Authorization There is hereby created a board as an adjunct to City Council named The Georgetown Tourism Development Board (hereinafter referred to as Board). Georgetown community; to a.) The purposes of the Board are to advise the City Council in establishing policy regarding financial resources intended to encourage tourism in the Georgetown community; to raise the public visibility of local activity which may attract visitors to the City of Georgetown, and to promote and enhance tourism in the convention and hotel industry. The Board is hereby directed to: tourism development board (csf 002872.ord) page I of 3 1) develop a plan including specific goals and objectives for promoting tourism and the preservation and appreciation of historic and cultural attributes of our community, such plan may be evaluated and revised, from time to time; 2) develop guidelines report to for evaluating proposals for the expenditure of funds to promote tourism; 3) provide a quarterly report to the City Council on its programs during the first 12 months of operation and on a timely basis thereafter as required by the City Council; first appointed shall be 4) annually submit a proposed budget for programs to promote tourism to the City Council; 5) operate in full compliance with the requirements of the state laws pertaining to open meetings, conflict of interest and open records; 6) recommend to the council, for action, contracts for services with certain tourism promotion providers. All contracts shall be written in conformity with appropriate state laws on contracts; 7) seek funds through grants from agencies and through fund-raising events; and all funds received shall be forwarded the city and are subject to budgeting review and approval. 2.30 Appointment (a.) The Board shall consist of eight (8) members recommended by the mayor and approved by the City Council. The terms of each of the members shall be three (3) years, except that the respective terms of two (2) of the members first appointed shall be one year, three (3) of the members first appointed shall be two years, and three (3) of the members first appointed shall be three years. The City of Georgetown Director of Community Development shall serve as ex officio member to the board. Additionally, by a (b.) In order to assure a broad base of community participation two nominees will be requested, of which one will be selected, from each of the following organizations: Chamber of Commerce, Downtown Georgetown Association, Heritage Society, and Southwestern University. Additionally, by a public call, will request nominations from the arts community, the hotel/motel industry, the restaurant/motel industry, and the business community. 2.31 By-laws The Board shall adopt, subject to review and approval by the City Council, by-laws in conformity to this ordinance and state law that shall govern the activities of the Board, tourism development board (csf 002872.ord) page 2 of 3 SECTION 3. If any Ordinance shall not affect the validity thereof other than section, paragraph, clause, be adjudged invalid or held of this Ordinance as a the part so declared to be phrase, or provision of this unconstitutional, the same shall whole or any part or provision invalid or unconstitutional. SECTION 4. This ordinance shall become effective upon adoption of its second and final reading by the City Council of the City of Georgetown, Texas.
