P' AN ORDINANCE AMENDING THE ZONING ORDINANCE PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS ON THE 12TH DAY OF FEBRUARY 1968, AMENDING A PART OF THE ZONING DISTRICT MAP OF THE ORIGINAL ORDINANCE, TO CHANGE A PORTION OF THE PROPERTY DESCRIBED IN DEED IN VOLUME 941, PAGE 468 OF THE DEED RECORDS OF WILLIAMSON COUNTY, TEXAS, AS Oe398 ACRES OF OUTLOT FOUR, DIVISION "A". IN THE CITY OF GEORGETOWN, TEXAS, FROM THE C-1 LOCAL COMMERCIAL DISTRICT TO THE C -2A COMMERCIAL FIRST HEIGHT DISTRICT ZONING CLASSIFICA- TION, AND ESTABLISHING CONDITIONS PRECEDENT TO THE ISSUANCE OF A BUILDING PERMIT FOR CONSTRUCTION OR RECONSTRUCTION OF IMPROVEMENTS ON SUCH PROPERTY. WHEREAS, an application has been made to the City Council for the purpose of changing the zoning district classification of the following described real property ("the Property"): A portion of Outlot Four (4), Division "A" in the City of Georgetown, Texas being the same property as described in a gleed executed by Eloise Bass to Bill Mott as recorded in Volume 941, Page 468 of the Deed Records of Williamson County, Texas, said property ,being mapped on page two of Exhibit "A," which ' is attached hereto and incorporated by reference herein® and WHEREAS, the City Council has submitted the proposed change in the Base Ordinance ,to the Planning and Zoning Commission for its consideration in a public hearing and for its recommendation or report, and WHEREAS, notice of such hearing was published in a newspaper of general circulation in the City, which stated the time and place of hearing, which time was not earlier than fifteen (15) days for the first day of such publication; and WHEREAS, written notice was given not less than fifteen (15) days before the date set for the meeting before the Planning and Zoning Commission to all the owners of the lots within two hundred feet of the property, as required by law; and WHEREAS, the applicant for such zoning change placed on the Property such sign(s) as required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen (15) days before the date set for such hearing; and WHEREAS, the City Planning and Zoning Commission in a meeting held on October 4, 1988, recommended the changing of said zoning district classifications provided in the Base Ordinance on the above described property from the C-1 LOCAL COMMERCIAL district to the C -2A COMMERCIAL FIRST HEIGHT district zoning classification; and Mott - Rezoning (ml 1920 Austin Ave Oct 12, 1988) P.1 of 3 WHEREAS, the City Council hereby finds that reasonable conditions are necessary to provide for the uniform development of the property within the proposed District and that such conditions are necessary for the protection of the surrounding properties and the general public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: Section One. All of the facts recited in the preamble hereby found by the Council to be true incorporated by reference herein and hereof, as if copied verbatim; Section Two. to this ordinance are and correct, and are expressly made a part (1) That the Base Ordinance and the Zoning Map of the City, as well as the Zoning District for the Property shall be and the same is hereby changed from the C-1 LOCAL COMMERCIAL district to the C -2A COMMERCIAL FIRST HEIGHT district. (2) The City requires the applicant for this zoning change to comply with the conditions set forth in Exhibit "A" attached hereto and incorporated by reference herein. No building permit nor certificate of occupancy shall be issued for any construction or reconstruction on such Property until the conditions are completed.The conditions imposed herein are not to be construed as conditions to the granting of zoning, but rather, they are conditions precedent to the issuance of building permits and certificates of occupancy. The rights and obligations of the applicant for zoning change under this ordinance shall be binding upon the applicant for zoning change and any subsequent owners of the Property. Planning and Zoning Commission approval of a Detailed Development Plan shall be required for any use not allowed by right in the C-1 zoning district, except for an auto repair garage; and 2. Project #01575 Owner/Applicant: Bill Mott 104 Oak Ridge Circle Georgetown, Texas 78628 863-6653 REQUEST: Rezoning from C-1 to C -2A of 0.398 acres of Outlet 4, Division A of the City of George- town, as described by deed in Volume 9.41, Pages 468-470 of the Deed Records of William- son County, Texas. FACTS: Location: Between 18th and 19th Streets at 1902 South Austin Avenue. Surrounding Uses and Zoning: See Exhibits A and B. Existing Use: The retail sale of auto parts and an auto repair garage. Proposed Use: Site redevelopment is not proposed. Notification: Proper notification of this request was com- pleted. As of September 15, 1988, the Plan - ping Department has -received one property owner comment form in favor of the requested rezoning. Comment forms in opposition to this request have not been received. ANALYSIS Overview: The section of Austin Avenue south of 18th Street is characterized by high intensity commercial uses and zoning districts. Uses such as gasoline stations, car lots, building supply centers and general contracting are typical along this section of Austin Avenue. Properties between 19th Street.and Leander. Road are zoned C -2A and I. However, the uses on most of these properties would be permit- ted by right in the C-1 and C -2A zoning dis- tricts, respectively. Zoning intensity de- creases to C-1 in the vicinity of the subject property as uses transition to the residen- tial uses north of 18th Street. Land Use: All of the properties surrounding the subject property are used for commercial and office uses and are zoned C-1 and C -2A (see Exhibits A and B). Adjoining the subject property to the west is an auto repair center, a general contractor and vacant property, zonedC-2A. General retail and office uses zoned C-1 are located north, south and east of the subject property. Because a portion of the subject property is used as an automobile garage, C -2A zoning is required to comply with the Zoning Ordinance. The owner has indicated that site redevelop- ment is not proposed and that C -2A zoning is required only to bring the existing use into. conformance with the Zoning Ordinance. Site Plan. In similar rezoning requests, the Council has approved rezoning subject to: 1} Planning and Zoning Commission approval of a Detailed Development Plan for any use not allowed by right in the C-1 zoning district, except for the existing use and 2) The submittal of a Detailed Development Plan (DDP) demonstrating compliance with the design standards of the Subdivision Regulations prior to the issuance of a building permit. However, because site development is not im- mediately proposed, the submittal 'of a DDP demonstrating compliance with the design standards of the Subdivision Regulations should only be required prior to issuance of a building permit. Design standards such as landscaping and buffering can then be utiliz- ed to ensure compatibility between uses. STAFF RECOMMENDATION: (September 15, 1988) The staff recommends approval of rezoning from C-1 to C -2A sub- ject to: 1) Planning and Zoning Commission approval of a Detailed De- velopment Plan for any use not allowed by right in the C-1 zoning district, except for an auto repair garage and 2) The submittal of a Detailed Development Plan (DDP) demonstrat- ing compliance with the design standards of the Subdivision Regulations prior to the issuance of a building permit. 1920 S. Austin Avenue 2 P&Z ACTION: (October 4, 1988) By a vote of 5-1, the Commission recommends approval of this request consistent with the staff recommendation of September 15,. 1988. The Commission finds that the allowed use appears to be a logical use of the site. The dissenting Commissioner stated that she was not opposed to the rezoning, but that she was opposed to the attachment of conditions to the rezoning. CITY COUNCIL ACTION. (October 25, 1988) By a vote of 4-0, the Council approved the rezoning as per the October 4, 1988, recommendation of the Planning and Zoning Commission. 1920 S.
