AN ORDINANCE VACATING AND ABANDONING PORTION OF O ALONGEASEMENT WHICH EXTENDS r s' PROPERTY OF LOTS 13 AND 14 OF GABRIEL ESTATES SUBDIVISION,1 RECORDED CABINETOF PLAT RECORDS OF • WHEREAS, Joe A. Maxwell desires to construct a single residence upon and over the common line of Lots 13 and 14, Block A of Gabriel Estates subdivision as recorded in Cabinet G Slide 313 of the Plat Records of Williamson County, Texas; and WHEREAS,, said common lot line is affected by a ten foot wide public utility easement; and WHEREAS,, said owner has petitioned the City of Georgetown for the abandonment of said easement as it relates to said Lots 13 & 14 of Block A, as shown on Exhibit "A" attached; and WHEREAS,, the utility companies serving the Gabriel Estates subdivision have determined that there exists no present or foreseeable future need for the easements9 and WHEREAS,, the City Council. finds it is no longer in the public interest for the City to maintain an easement for utilities at this location and therefore recommends abandoning the same;` NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, that the City hereby abandons and vacates the ten (10) foot public utility easement located along and parallel to the common property line of the property now known as Lots 13 & 14, Block A of Gabriel Estates subdivision, of record in, Cabinet G, Slide 313 of the Official Plat Records of'Williamson County, Texas. Maxwell 3411 Rocky Hollow Trail Georgetown, Texas 78628 863-8519 BUILDING LINE Variance to the plat requirement that no building be placed within 10 feet of a side lot line and abandonment of a ten foot Public Uti- lity Easement (PUE) located along the common property line of Lots 13 and 14, Block A, Gabriel Estates, a plat recorded in Cabinet G Slide 313 of the Plat Records of Williamson County, Texas. Within the Gabriel Estates subdivision, northwest of the corporate limits of the City, and within the ETJ. Single family residential and vacant land. Undeveloped Construction of a single residence that would extend across the lot line between Lots 13 and 14, Block A, Gabriel Estates subdivision (See Exhibit A). In support of this request, the applicant contacted the following utilities that provide service to Gabriel Estates subdivision. Chisholm Trail Water Supply Corporation, Peder- nales Electrical Coop Inc. and G.T.E. Each of these utility companies indicated that the two five foot PUE's adjacent to the common property line of Lots 13 and 14 did not contain utilities and that the abandonment of each PUE was acceptable. STAFF RECOMMENDATION: (October 26, 1988) The staff recommends approval of requested variance note requiring a ten ft. building setback from side approval of the requested abandonment of the ten ft. the side lot line separating lots 13 and 14. from the plat lot lines and easement along I P & Z ACTION. (November 1, 1988) By a`vote of 7-0, the Commission recommended approval of requested variance from the plat note requiring a ten ft. building setback from the common side lot line between lots 13 and 14. Approval of the requested abandonment of the ten ft. easement along the side lot line separating lots 13 and 14 is also recommended. CITY COUNCIL ACTION: (November 8, 1988) By a vote of 3-0, the Council approved the requested variance and abandonment as per the November 1, 1988 recommendation of the P & Z.
