HomeMy WebLinkAboutORD 880381 - Zoning from RS to RM-3ORDINANCE NO. = x AN ORDINANCE AMENDING THE ZONING ORDINANCE PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS ON THE 12TH DAY OF FEBRUARY 1968, AMENDING A PART OF THE ZONING DISTRICT MAP OF THE ORIGINAL ORDINANCE, TO CHANGE A PORTION OF THE PROPERTY DESCRIBED IN DEED IN VOLUME 947, PAGE 93 OF THE DEED RECORDS OF WILLIAMSON COUNTY, TEXAS, AS LOT FOUR, BLOC. FOUR, OF THE GLASSCOCK ADDITION, IN THE CITY OF GEORGETOWN, TEXAS, FROM THE RS RESIDENTIAL SINGLE-FAMILY DISTRICT TO THE -3 OFFICE AND SERVICE USE DISTRICT ZONING CLASSIFICATION, AND ESTABLISHING CONDITIONS PRECEDENT TO THE ISSUANCE OF A BUILDING PERMIT FOR CONSTRUCTION OR RECONSTRUCTION OF IMPROVEMENTS ON SUCH PROPERTY. WHEREAS, an application has been made to the City Council for the purpose of changing the zoning district classification of the following described real property ("the Property"): Lot Four (4), Bloch Four (4) of the Glasscock Addition, an addition in and to the City of Georgetown, being the same property as described in a deed executed by Bernice M. Love and Thomas O. Love to Citizens State Bank of 900 Austin Avenue, Georgetown, Williamson County, Texas, recorded in Volume 94.7, Page 93 of the Deed 'Records of Williamson County, Texas, said property being mappedon page two of Exhibit 'A," which is attached hereto and incorporated by reference herein; and WHEREAS, the City Council has submitted the proposed change in the Base Ordinance to the Planning and Zoning Commission for its consideration in a,public hearing and for its recommendation or report; and WHEREAS, notice of such hearing was published in a newspaper of general circulation in the City, which stated the time and place of hearing, which time was not earlier than fifteen (15) days for the first day of such publication; and WHEREAS, written notice was days before the date set for the Zoning Commission to all the hundred feet of the property, as given not less than fifteen (15) meeting before the Planning and owners of the lots within two required by law; and WHEREAS, the applicant for such zoning change placed on the Property such sign(s) as required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen (15) days before the date set for such hearing; and WHEREAS, the City Planning and Zoning Commission in a meeting held on October 4, 1988, recommended the changing of said zoning district classifications provided in the Base Ordinance on Citizen's State Bank - Rezoning (ml 912 Rock Oct 12, 1988) P.1 of 3 the above described property from the RS RESIDENTIAL SINGLE-FAMILY District to the _RM -3 OFFICE AND SERVICE USE District zoning classification; and WHEREAS, the City Council hereby finds that reasonable conditions are necessary to provide for the uniform development of the property within the proposed District and that such conditions are necessary for the protection of the surrounding properties and the general public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: Section One. All of the facts recited in the preamble to this ordinance are hereby found by the Council to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim; Section Two. (1) That the Base Ordinance and the Zoning Map of the City, as well as the Zoning District for the Property shall be and the same is hereby changed from the RS RESIDENTIAL SINGLE-FAMILY District to the RM -3 OFFICE AND SERVICE USE District. (2) The City requires the applicant for this zoning change to comply with the conditions set forth in Exhibit R1A" attached hereto and incorporated by reference herein. No building permit nor certificate of occupancy shall be issued for any construction or reconstruction on such Property until the conditions are completed. The conditions imposed herein are not to be construed as conditions to the granting of zoning, but rather, they are conditions precedent to the issuance of building permits and certificates of occupancy. The rights and obligations of the applicant for zoning change under this ordinance shall be binding upon the applicant for zoning change and any subsequent owners of the Property. Proposed Use History: Notif ication o ANALYSIS; Fred Knauth Rezoning of Lot 4, Block 4 of the Glasscock Addition from RS to C-1. At the northwest corner of the intersection of Rock and 10th Streets, at 912 Rock Street. See Exhibits A and B. The subject property is vacant. The applicant proposes to construct an off-site parking lot for the bank. The subject property is located within the bounds of the Northwest Central Area Plan. The plan recommends moderate density resi- dential uses at this location. Proper notification of this request was com- pleted. As of September 29, 1988, the Plan- ning Department has received four property owner comment forms in favor of the requested rezoning. No comment forms in opposition to this request have been received. Relative to the subject property, Exhibit C shows the lo- cation of properties where owners have re- sponded favorably to this request. The subject property is located southwest of the central business district in a block that may eventually transition to higher intensity uses. While RS zoning comprises the southern half of this block, the northern half is zon- ed C -2A and C -2B. The majority of the resi- dences in this block and in the immediate vi- cinity are in good condition, but are sur- rounded by commercially zoned properties along 9th Street and Austin and University Avenues. These factors led to the Northwest Central Area Plan's recommendation to allow transition to moderate density residential. uses for those properties located along 10th 11, Street between Rock King Street, which perty. Street and Martin Luther includes the subject pro. The owners have indicated potential use of this property for a parking lot or office building, which requires only RM -3 zoning. However, a specific use is not proposed and.a site plan has not been presented. The RM -3 district allows all RS, RM -1 and RM -2 uses by right, in addition to personal service shops and offices less than 5000 square feet in area. The C-1 district would permit all gen- eral retail uses and cater to a larger ser- vice area than uses in the RM -3 district. RM -3 use at this location is consistent with the intent of the Northwest Central Area Plan recommendation to create a transition zone along the north side of 10th Street. While the plan envisioned moderate density residen- tial uses (RM -2) as a transition between the: residential and commercial uses along 10th Street, RM -3 would serve as a comparable transition. Site Plan: The RM -3 district regulations do not require landscaping, buffering and other aesthetic considerations designed to soften the impact of a new development and promote compatibili- ty between uses. Since residences are located to the north, 'south, and west of the subject property, compatibility is an important con- sideration. This site also contains several significant treeas, and site access at the intersection of 10th and Rock Streets is an additional site design concern. Because the Subdivision Regulations contain provisions addressing each of these site planning is- sues, the Commission and Council have approv- ed similar rezoning requests conditional upon the submittal of a detailed development plan (DDP) demonstrating compliance with the de- sign standards of the Subdivision Regulations before the site is developed. STAFF RECOMMENDATION: (September 29, 1988) The staff recommends approval of rezoning from RS to C-1 subject to% a. The submittal of a Detailed Development Plan (DDP) demonstra- ting compliance with the design standards of the Subdivision Regulations prior to the issuance of a building permit and 912 Rock Street 2 b. Planning and Zoning Commission approval of a DDP for any use not allowed by right in the RM -3 district, except parking. P&Z ACTION. (October 4, 1988) By a vote of 5-1, the Commission recommends disapproval of this request. The Commission recommends approval of rezoning from RS to RM -3 subject to: The submittal of a Detailed Development Plan (DDP) for the Planning and Zoning Commission approval demonstrating compliance with the design standards of the Subdivision Regulations prior to the issuance of a building permit for any use not allowed in the RS district. The Commission emphasized the importance of buffering in accordance with the design standards to minimize impacts on the adjoining residence. The dissenting Commissioner opposed the rezoning as an inappropriate encroachment into the existing neighborhood.
