SECTION 23-1 (C) "SEWER RATESt1; ARTICLE I. CHAPTER 23-1 (G) "PAYMENT AND COLLECTIONP°; ARTICLE I, SECTION 23-1, 41RATES AND CHARGES FOR CITY SERVICE ---SCHEDULES"; ARTICLE I. CHAPTER 23, BY ADDING A NEW SUBSECTION, SECTION 23-1 (J) "TEMPORARY SERVICE"; ARTICLE I. CHAPTER 23; BY ADDING A NEW SUBSECTION, SECTION 23-33 (C) 41EXEMPTION"; ARTICLE III, CHAPTER 23, PROVIDING A REPEALING CLAUSE, PROVIDING A SAVINGS CLAUSE AND SETTING AN EFFECTIVE DATE. WHEREAS, the City of Georgetown, Texas finds it necessary and proper and in the best interest of the citizens of Georgetown, Texas to amend the City of Georgetown, Texas Code of Ordinances, Chapter 23, Article I, Section 23-1 (C) entitled "Sewer Rates"; and WHEREAS, the City of Georgetown, Texas finds it necessary and proper and in the best interest of the citizens of Georgetown, Texas to amend the City of Georgetown, Texas Code of Ordinances, Chapter 23, Section 23-1 (G) entitled "Payment and Collection"; and WHEREAS, the City of Georgetown, Texas finds it necessary and proper and in the best interest of the citizens of Georgetown, Texas to amend the City of Georgetown, Texas Code of Ordinances, Chapter 23, Article I, Section 23-1 to provide temporary service for electric and water services by adding a new subsection (J) entitled "Temporary ServiceP°; and WHEREAS, the City of Georgetown, Texas finds it necessary and proper and in the best interest of the citizens of Georgetown, Texas to amend the City of Georgetown, Texas Code of Ordinances, Chapter 23, Article III, Section 23-33 entitled "Garbage Collection and Charges Therefor Mandatory" by adding a new subsection (C) entitled "Exemption" to provide for exemption for vacant homes under contract to sell. Anyone whose home is both vacant and under contract to sell, will be exempt from paying for sewer service upon application for exemption with the Utility Office, SECTION 2. That the City of Georgetown Code of Ordinances, Chapter 23, Article I, Section 23-1 (G) entitled "Payment and Collection" is hereby amended to read as follows: (G) PAYMENT AND COLLECTION: Payments shall be considered timely and not delinquent if the payment is received prior to the due date (fifteen (15) days following the billing date for service), or if payment bears a postmark within such limit, or payment is received in the overnight depository by 8:00 a.m. the following day. When the said due date falls on a weekend or a legal City holiday, such time for payment shall be extended to the next business day. When payment is not received by the due date, a ten percent (10%) penalty will be added to the account and a final notice will be mailed. If payment is not received in the allotted time stated on the final notice, utility services will be discontinued and an additional $20.00 service charge will be added to each account. The customer will be required to pay the account in full, by cash, before services will be reconnected. SECTION 3. That the City of Georgetown Code of Ordinances, Chapter 23, Article I, Section 23-1, entitled "Rates and Charges for City Service ---Schedules" is hereby amended by adding the following subsection (J) entitled "Temporary Service1* (J) TEMPORARY SERVICE: Temporary Service of utilities is available for a five (5) day period at a cost of $35.00, maximum consumption being 100 KWH of electricity and 2,000 gallons of water. SECTION 4. That the City of Georgetown Code of Ordinances, Chapter 23, Article III, Section 23-33, entitled "Garbage Collection and Charges Therefor Mandatory" is hereby amended by adding the following subsection (C) entitled "Exemption". 08/23/88 utilities ordinance (csf util.ord) Page 2 of 4 (C) Exemption. Anyone whose home is both vacant and under contract to sell, will be exempt from paying the garbage rate upon application for exemption with the Utility Office. SECTION 5. That all ordinances, resolutions and/or parts of ordinances and resolutions in conflict herewith are hereby repealed and rescinded. SECTION 6. If an section, paragraph, clause, phrase, or provision of this Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so declared to be invalid or unconstitutional. SECTION 7. This Ordinance shall become effective upon adoption of its second and final reading by the City Council of the City of Georgetown, Texas, and its publication within ten (10) days after adoption.
