AN ORDINANCE AMENDING THE ZONING ORDINANCE PASSED AND
ADOPTED BY THE CITY COUNCIL OF THE CI'T'Y OF GEORGETOWN, TEXAS
ON THE 12TH DAY OF FEBRUARY 1968, AMENDING A PART OF THE
ZONING DISTRICT MAP OF THE ORIGINAL ORDINANCE, TO CHANGE
THE PROPERTY DESCRIBED AS LEE MOTOR PLACE IN CABINET J
SLIDE 117 OF THE OFFICIAL PLAT RECORDS OF WILLIAMSON
COUNTY, TEXAS IN THE L. DYCHES SURVEY ABSTRACT NO. 180, IN
THE CITY OF GEORGETOWN, TEXAS, FROM THE R -S RESIDENTIAL
SINGLE FAMILY DISTRICT TO THE C2 -A COMMERCIAL FIRST 'HEIGHT
DISTRICT ZONING CLASSIFICATION, AS HEREINAFTER SET FORTH;
WHEREAS, an application has been made to the City Council
for the purpose of changing the zoning district classification of
the following described real property:
A 4.727 acre subdivision located along the southbound
IH -35 frontage road `between Westinghouse Road and US Business
Highway'81, known as Lee Motor Place, as recorded in Cabinet
3 Slide 117- of the Official Plat Records of Williamson
County, Texas; and
WHEREAS, the City Council has submitted the ,proposed change
in the Zoning Ordinance to the Planning and Zoning Commission for
its recommendation and report; and
WHEREAS, the City Council, before adopting this amendment to
the Zoning Ordinance, gave notice of such hearing by publishing
same in a newspaper of general circulation in the City of George-
town, Texas, which notice stated the time and place of hearing,
and which time was not earlier than fifteen days from the first
day of such publication; and
WHEREAS, written notice was given not less than fifteen (15)
days before the date set for the meeting before the Planning and
Zoning Commission, to all the owners of the lots within 200 feet
of the above described property, as required by law; and
WHEREAS, the applicant for such zoning change placed on the
property for which such change is applied such sign(s) as re
quired by law for advertising the Planning and Zoning Commission
hearing, not less than fifteen (15) days before the date set for
said hearing; and
WHEREAS, on January 5, 1988, the Planning and Zoning Com-
mission, with careful regard to the potential adverse impacts of
the proposed amendment on surrounding property owners and the
general public, recommended certain reasonable conditions which,
obtained prior to the issuance of the building permit for

construction or reconstruction on the Property, were intended to
mitigate potential adverse impacts on the surrounding properties
and to promote general welfare; and
WHEREAS, the Planning and Zoning Commission recommended the
changing of said zoning district classifications provided in the
Base Ordinance on the above described Property from the R -S
RESIDENTIAL SINGLE-FAMILY District to the C2 -A COMMERCIAL FIRST
HEIGHT District zoning classifications and
WHEREAS, the City Council hereby finds that the conditions
imposed are reasonably necessary to the uniform development of
the property within the proposed District and that such
conditions are necessary for the protection of the surrounding
properties and the general public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS®
Section One. All of the facts recited in the preamble to this
ordinance are hereby found by the Council to be true and correct,
and are incorporated by reference herein and expressly made a
part hereof, as if copied verbatimP
Section Two.
(1) That the Base Ordinance and the Zoning Map of the City, as
well as the Zoning District for the Property shall be and the
same is hereby changed from the R -S RESIDENTIAL SINGLE-FAMILY
District to the C2-ACOMMERCIAL FIRST HEIGHT District.
(2) The City requires the applicant for this zoning change to
comply with the conditions set forth in Exhibit "A" attached
hereto and incorporated by reference herein. No building permit
nor certificate of occupancy shall be issued for any
construction or reconstruction on such Property until the
conditions are completed. The conditions imposed herein are not
to be construed as conditions to the grant of zoning, but rather,
they are conditions precedent to the issuance of building permits
and certificates of occupancy. The rights and obligations of the
applicant for zoning change under this ordinance shall be binding
upon the applicant for zoning change and any subsequent owners of
the Property.

The following condition shall be applicable to the above
described property:
1. Upon any redevelopment of the aforementioned pro-
perty requiring a building permit, the front yard
requirements of the Zoning Ordinance shall be com-
plied with.
