AN ORDINANCE AMENDING THE ZONING ORDINANCE PASSED AND
ADOPTED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS
ON THE 12TH DAY OF FEBRUARY 1968, AMENDING A PART OF THE
ZONING DISTRICT MAP OF THE ORIGINAL ORDINANCE, TO CHANGE
LOT 3-A, BLOCK ONE, GABRIEL HEIGHTS ADDITION IN THE N_.

LOCAL COMMERCIAL DISTRICT ZONING CLASSIFICATION AND TO
CHANGE LOT 4-A, BLOCK ONE, GABRIEL HEIGHTS ADDITION IN THE

GEORGETOWN, TEXAS, FROM R -S RESIDENTIAL SINGLE FAMILY TO THE
RM -3 RESIDENTIAL MULTI -FAMILY RESIDENTIAL DISTRICT ZONING
CLASSIFICATION, AND ESTABLISHING CONDITIONS PRECEDENT TO THE
ISSUANCE OF A BUILDING PERMIT FOR CONSTRUCTION OR
RECONSTRUCTION OF IMPROVEMENTS ON SUCH PROPERTY.
WHEREAS, an application has been made to the Council for the
purpose of changing the zoning district classification of the
following described real property.
Lots 3-A and 4-A, Block 1, Gabriel Heights Addition; and
WHEREAS, the City Council has submitted the proposed .change
in the Base Ordinance to the City Planning and Zoning Commission
for its consideration in a public hearing and for its
recommendation or report; and
WHEREAS, written notice of such hearing was published in a
newspaper of general circulation in the.,City, which stated the
time and place of hearing, which time was not earlier than
fifteen (15) days for the first day of such publication] and
WHEREAS, written notice was
days before the date set for the
Zoning Commission, to all the
hundred feet of the property, as
given not less than fifteen (15)
meeting before the Planning and
owners of the lots within two
required by law, and
WHEREAS, the applicant for such zoning change placed on the
Property such sign(s) as required by law for advertising the
Planning Zoning Commission hearing, not less than fifteen (15)
days before the date set for such hearing; and
WHEREAS,
on July
7, 1987,
the
Commission, with careful
regard to the
potential
adverse
impacts
of the proposed amendment
on surrounding property owners and the general public,
recommended certain reasonable conditions which, obtained prior
to the issuance of the building permit for construction or
reconstruction on the Property, were intended to mitigate
potential adverse impacts on the surrounding properties and to
promote general welfare, and

WHEREAS, the Commission recommended the changing of said
zoning district classifications provided in the Base Ordinance on
the above described LOT 3-A from the R -S RESIDENTIAL
SINGLE-FAMILY and RM -3 RESIDENTIAL MULTI -FAMILY Districts to the
C-1 LOCAL COMMERCIAL District zoning classification and
recommended the changing of said zoning district classifications
provided in the Base Ordinance on the above described LOT 4-A
from the R -S RESIDENTIAL SINGLE-FAMILY District to the RM -3
RESIDENTIAL MULTI -FAMILY District,
WHEREAS, the City Council hereby finds that the conditions
imposed are reasonably necessary to the uniform development of
the property within the proposed District and that such
conditions are necessary for the protection of the surrounding
properties and the general public.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS:
Section One. All of the facts recited in the preamble to this
ordinance are hereby found by the Council to be true and correct,
and are incorporated by reference herein and expressly made a
part hereof, as if copied verbatim;
Section Two.
(1) That the Base Ordinance and the Zoning Map of the City, as
well as the Zoning District for the Property shall be and the
same is hereby changed from the R -S RESIDENTIAL SINGLE-FAMILY
and RM -3 RESIDENTIAL MULTI -FAMILY Districts to the C-1 LOCAL
COMMERCIAL District for LOT 3=A and that the Base Ordinance and
the Zoning Map of the City, as well as the Zoning District for
the Property shall be and the same is hereby changed from the
R -S RESIDENTIAL SINGLE-FAMILY District to the RM -3 RESIDENTIAL
MULTI -FAMILY District for LOT 4-A.
(2) The City requires the applicant for this zoning change to
comply with the conditions set forth in Exhibit "A" attached
hereto and incorporated by reference herein. No building permit
nor certificate of occupancy shall be issued for any
construction or reconstruction on such Property until the
conditions are completed. The conditions imposed herein are not
to be construed as conditions to the grant of zoning, but rather,
they are conditions precedent to the issuance of building permits
and certificates of occupancy. The rights and obligations of the
applicant for zoning change under this ordinance shall be binding
upon the applicant for zoning change and any subsequent owners of
the Property.

The following conditions shall be applicable to the above
described propertym
1. Development and occupancy shall be restricted to only
office uses, financial institutional use, and required
parking.
2. Improvements shall conform to the Detailed Development
Plan approved by the City coui,cil on July 28, 1987 (Refer

3e Upon occupancy, as described in Part One above, the owner
shall provide for the perpetual placement and maintenance
of each of the fences, berms, trees, and landscaping
features indicated on the Detailed Development Plan.
