HomeMy WebLinkAboutORD 880115.00A - REZ Tract RS to C2AORDINANCE NO* V V B 00 119 g AN ORDINANCE AMENDING THE ZONING ORDINANCE PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS ON THE 12TH DAY OF FEBRUARY 1968, AMENDING A PART OF THE ZONING DISTRICT MAP OF THE ORIGINAL ORDINANCE, TO CHANGE THE PROPERTY DESCRIBED IN DEED IN VOLUME 1014, PAGE 592 OF THE OFFICIAL DEED RECORDS OF WILLIAMSON COUNTY TEXAS IN THE Lm DYCHES SURVEY ABSTRACT NO. 180, IN THE CITY OF GEORGETOWN, TEXAS, FROM THE R -S RESIDENTIAL SINGLE FAMILY DISTRICT TO THE C2 -A COMMERCIAL FIRST HEIGHT DISTRICT ZONING CLASSIFICATION, AND ESTABLISHING CONDITIONS PRECEDENT TO THE ISSUANCE OF A BUILDING PERMIT FOR CONSTRUCTION OR RECONSTRUCTION OF IMPROVEMENTS ON SUCH PROPERTY. WHEREAS, an application has been made to the City Council for the purpose of changing the zoning district classification of the following described real property: A 4.37 acre tract contiguous to the southbound IH -35 frontage road approximately two 'miles south of the south junction of IH -35 US Business Highway 81, and Described by deed in Volume 1014, Page 592 of the Official Deed Records of Williamson 'County, Texas; and `WHEREAS, the City Council has submitted the ,proposed change in the Base Ordinance to the Planning and Zoning Commission for its consideration in a public hearing and for its recommendation or report; and WHEREAS, notice of such hearing was published in of general circulation in the City, which stated place of hearing, which time was not earlier than days for the first day of such publication, and WHEREAS, written notice was days before the date set for the Zoning Commission to all the hundred feet of the property, as given not less than meeting before the owners of the lots required by law; and a newspaper the time and fifteen (15) August fifteen (15 ) Planning and within two WHEREAS, the applicant for such zoning change placed on the Property such sign(s) as required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen (15) days before the date set for such hearing; and WHEREAS, the City Planning and Zoning meeting held on August 4, 1987, recommended the zoning district classifications provided in the the above described property from the SINGLE-FAMILY District to the C2 -A COMMERCI District zoning classification; and Commission In a changing of said Base Ordinance on R -S RESIDENTIAL AL FIRST HEIGHT Newberg - Rezoning (psf NEWBERG2 2/3/88) P. 1 of 4 WHEREAS, the City Council hereby finds that reasonable conditions are necessary to provide for the uniform development of the property within the proposed District and that such conditions are necessary for the protection of the surrounding properties and the general public. NOW, THEREFORE, BE CITY OF GEORGETOWN, TEXAS: IT ORDAINED BY THE CITY COUNCIL OF THE Section One. All of the ordinance are hereby found and are incorporated by facts recited in by the Council to reference herein the preamble be true and and expressly to this correct, made a part hereof, as if copied verbatim; Section Two. (1) That the Base Ordinance and the Zoning Map of the City, as well as the Zoning District for the Property shall be and the same is hereby changed from the R -S RESIDENTIAL SINGLE-FAMILY District to the C2 -A COMMERCIAL FIRST HEIGHT District. (2) The City requires the applicant for this zoning change to comply with the conditions set forth in Exhibit "A" attached hereto and incorporated by reference herein. No building permit nor certificate of occupancy shall be issued for any construction or reconstruction on such Property until the conditions are completed.' The conditions imposed herein are not to be construed as conditions to the grant of zoning, but rather, they are conditions precedent to the issuance of building permits and certificates of occupancy. The rights and obligations of the applicant for zoning change under this ordinance shall be binding upon the applicant for zoning change and any subsequent owners of the Property.
