HomeMy WebLinkAboutORD 880098.14 - Southwestern PlazaORDINANCE NO. 00q °f AN ORDINANCE VACATING AND ABANDONING A PORTION OF A TWENTY -FOOT (20.01) PUBLIC UTILITY EASEMENT (PUE), AND ALL UTILITIES CONTAINED THEREIN, LOCATED WITHIN LOT ONE BLOCK ONE OF _ SOUTHWESTERN PLAZA, A SUBDIVISION RECORDED IN CABINET H. SLIDE 121 OF THE OFFICIAL PLAT RECORDS OF WILLIAMSON COUNTY, TEXAS, THEREBY RELINQUISHING ALL CITY RESPONSIBILITY FOR MAINTAINING ANY AND ALL UTILITIES CONTAINED WITHIN THE SAID PUE AND EXCEPTING AND RESERVING UNTO THE CITY OF GEORGETOWN THE ABILITY TO INSPECT THE FIRE HYDRANT LOCATED WITHIN THE SAID PUE FOR THE PURPOSE OF AFFIRMING COMPLIANCE WITH FIRE CODE REQUIREMENTS, AS MAY BE NECESSARY FROM TIME TO TIME. WHEREAS, Herman E. Haenel is the owner of Lot 1 Block 1 of Southwestern Plaza, as recorded in Cabinet H Slide 121 of the Official Plat Records of Williamson County, Texas, a part of which is affected by a 20 -foot PUE described more particularly in Exhibit As and WHEREAS, said owner has constructed a building located partially within the said PUE; WHEREAS, to abandon the abandonment to the existing within the said said owner has petitioned the City of Georgetown said easement described in Exhibit A, and by such relinquish all City responsibility for maintaining fire line, fire hydrant and storm sewer located code requirements; and PUE; and WHEREAS, the utility property have determined companies serving the above described that there exists no present or foreseeable future need for said PUE; and WHEREAS, the Fire Marshal law retain the ability to of inspect the the City of Georgetown will by fire hydrant located within a portion of the said PUE so as to ensure compliance with fire code requirements; and WHEREAS, the City Council finds that it is no longer in the public interest for the City to perform maintenance of utility improvements within said PUE; and SW PLAZA - ABANDONMENT (raf SWPLAZA 2/17/88) P. 1 of 3 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, that the City hereby abandons and vacates that portion of a twenty (20) foot public utility easement, and all utilities contained within (being more particularly described in Exhibit A), within Lot One Block One of Southwestern Plaza, a subdivision recorded in Cabinet H, Slide 121 of the Official Plat Records of Williamson County, Texas,* thereby relinquishing all City responsibility for maintaining any and all utilities contained within the said PUE and excepting and reserving unto the City of Georgetown the ability to inspect the fire hydrant located within the abandoned PUE for the purpose of affirming compliance with fire code requirements, as may be necessary from time to time. THE CENTERLINE OF SAID 20.0 FOOT PUBLIC UTILITY EASEMENT BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING at a point in the interior of said Lot 1, Block 1 from which the Northwest corner of said Lot 1, Block 1 bears N. 03 deg. 18' 57" E., 236.48 feet for the Western most portion of this easement and the POINT OF BEGINNING. THENCE S. 73 deg. 15' 14" E., 200.00 feet. THENCE S. 16 deg. 44' 46" W., 53.00 feet to the POINT OF TERMINATION.
