MosooA AN ORDINANCE AMENDING THE ZONING ORDINANCE PASSED AND ADOPTED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS ON THE 12TH DAY OF FEBRUARY 1968, AMENDING A PART OF THE ZONING DISTRICT MAP OF THE ORIGINAL ORDINANCE, TO CHANGE THE PROPERTY DESCRIBED IN DEED IN VOLUME 928, PAGE 509 OF THE OFFICIAL DEED RECORDS OF WILLIAMSON COUNTY, TEXAS IN THE N. PORTER SURVEY ABSTRACT NO. 497, IN THE CITY OF GEORGETOWN, TEXAS, FROM THE RM-2 RESIDENTIAL MULTI-FAMILY DISTRICT TO THE C2-A COMMERCIAL FIRST HEIGHT DISTRICT ZONING CLASSIFICATION, AND ESTABLISHING CONDITIONS PRECEDENT TO THE ISSUANCE OF A BUILDING PERMIT FOR CONSTRUCTION OR RECONSTRUCTION OF IMPROVEMENTS ON SUCH PROPERTY. WHEREAS, an application has been made to the Council for the purpose of changing the zoning district classification of the following described real property0 Two tracts of land out of the Nicholas Porter Survey #497, being 37,102.24 square feet and 28,154.5 square feet in size, and being more particularly described`12y deed recorded in Volume 928, Page 509 of the Deed Records of Williamson County, Texas; and WHEREAS, the City Council has submitted the proposed change in the Base Ordinance to the Planning and Zoning Commission for its consideration in a public hearing and for its recommendation or report; and WHEREAS, notice of such hearing was published in a newspaper of general circulation in the City,_ which stated the time and place of hearing, which time was not earlier than fifteen (15) days for the first day of such publication; and WHEREAS, written notice was given not less than fifteen (15) days before the date set for the meeting before the Planning and Zoning Commission to all the owners• of the lots within two hundred feet of the property, as required by law; and WHEREAS, the applicant for such zoning change placed on the Property such sign(s) as required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen (15) days before the date set for such hearing; and WHEREAS, on June 2, 1987, the Planning and Zoning Commission, with careful regard to the potential adverse impacts of the proposed amendment on surrounding property owners and the general public, recommended certain reasonable conditions which, obtained prior to the issuance of the building permit for construction or reconstruction on the Property, were intended to mitigate potential adverse impacts on the surrounding properties and to promote general welfare; and 1603 NORTHWEST - REZONING (psf MMZOrd#4 12/10/87) P. 1 of 5 WHEREAS, the Commission recommended the changing of said zoning district classifications provided in the Base Ordinance on the above described Property from the RM -2 RESIDENTIAL MULTI -FAMILY District to the C2 -A COMMERCIAL FIRST HEIGHT District zoning classification; and WHEREAS, the City Council hereby finds that the conditions imposed are reasonably necessary to the uniform development of the property within the proposed District and that such conditions are necessary for the protection of the surrounding properties and the general public. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: Section One. All of the facts recited in the preamble to this ordinance are hereby found by the Council to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim; Section Two. (1) That the Base Ordinance and the Zoning Map of the City, as well as the Zoning District for the Property shall be and the same is hereby changed from the RM -2 'RESIDENTIAL MULTI -FAMILY District to the C2 -A COMMERCIAL FIRST HEIGHT District. (2) The City requires the applicant for this zoning change to comply with the conditions set forth in Exhibit "A" attached hereto and incorporated by reference herein. No building permit nor certificate of occupancy shall be issued for any construction or reconstruction on such Property until the conditions are completed. The conditions imposed herein are not to be construed as conditions to the grant of zoning, but rather, they are conditions precedent to the issuance of building permits and certificates of occupancy. The rights and obligations of the applicant for zoning change under this ordinance shall be binding upon the applicant for zoning change and any subsequent owners of the Property. Dated this (City Seal) City Secretary , 190 1603 NORTHWEST - REZONING (psf MMZOrd#4 12/10/87) P. 3 of 5 Property* Two tracts of land out of the Nicholas Porter Survey #149, being 37,102.24 square feet and 28,154.50 square feet in size, and being more particularly described by deed in Volume 928, Page 509 of the Deed Records of Williamson County, Texas. The following conditions shall be applicable to the above described property commencing on the effective date of the amendatory ordinance rezoning such property to the C2 -A Commercial First Height zoning district: 1) The entirety of the above described property, referred to herein as "the site", will be bound by these conditions. 2) The site shall be used solely for office and office/ware- house uses. 3) The provisions contained within this Section 3 shall apply at such time as those existing structures on this site are enlarged or their use significantly changed or the site is redeveloped to provide additional structures. a. Bulk plane provisions shall apply to all structures and all outdoor storage contained within this site. At the building setback line established 15 feet from the common property line of Lot 8 Block C of Gateway North- west and this site, any new structures and storage materials may attain a height of 10 feet. Proceeding south from the building setback line, a structure or stored materials and goods may attain one additional foot in height for every two feet of additional setback. b. Vehicular loading and service doors shall not directly face the adjoining Lot 8 Block C Gateway Northwest, unless said vehicular loading and service doors are located more than 100 feet from such adjoining residential lot. c. A six foot high opaque wooden or masonry fence will be placed along the common property line between Lot 8 Block C Gateway Northwest and the site. The opaque fence shall run for the entire 137.50 feet of the common property line of the residential lot, except for the 15 feet along this common boundary nearest to Washam Drive. The fence runners shall not face the residentially zoned lot. d. Na exterior lighting source shall cause offensive glare or reflection visible from the adjacent residential properties. e. Refuse containers shall be screened from view of 1603 NORTHWEST - REZONING (psf MMZOrd#4 12/10/87) P. 4 of 5 f. M MI ie residentially zoned properties by a structure one foot greater in height than the container. The refuse container must be capable of preventing the spread of blowing debris. Fuel storage and fuel pumps shall not be located within 25 feet of any residentially zoned property, if required by law. All off-street parking spaces and vehicle or material storage areas, as well as accompanying maneuvering areas and driveway access shall have a paved dust free surface. Outdoor storage (including storage tanks) shall be bound by same bulk plane provisions detailed in item #3a above. Outdoor storage may occur in the 15 foot yard required by the Zoning Ordinance on this site adjacent to Lot 8 Block C of Gateway Northwest, provided that the height of the stored materials does not exceed the six foot height of the opaque fence, as required by these covenants. Any new access to this site shall be prohibited within 50 feet of Lot 8 Block C Gateway Northwest. 1603 NORTHWEST - REZONING (psf MMZOrd#4 12%10/87) P. 5 of 5
