HomeMy WebLinkAboutORD 088-0061.00B.8 - Adopting RegulationsAN ORDINANCE ADOPTING REGULATIONS FOR THE SUBDIVI- SION AND DEVELOPMENT OF LAND WITHIN THE TERRITORIAL JURISDICTION OF THE CITY OF GEORGETOWN, TEXAS; REPEALING CONFLICTING REGULATIONS$ PROVIDING A SUNSET CLAUSE; PROVIDING FOR A PENALTY CLAUSE, AND PROVIDING A SAVINGS CLAUSE WHEREAS, under the provisions of the Constitution and laws of the State of Texas, including particularly, Chapters 231, Acts of the 40th Legislature, Regular Session, 1927, as heretofore or hereafter amended, (Compiled as Articles 974A, VACS), and the provisions of Section 4 of the Municipal Annexation Act (Compiled as Article 970A), as heretofore or hereafter amended, and the provisions of the Charter of the City of Georgetown, Texas, hereinafter referred to as "City", including particularly Article 1, Sections 1.02 and 1.06A, the City is authorized to develop regulations for the subdivision and development of land in the territorial jurisdiction of the City, including the corporate limits, extraterritorial jurisdiction and other areas as permitted by law; and WHEREAS, the City did adopt Subdivision Regulations on the 10th day of May, 1977 which have been amended from time to time, and WHEREAS, said regulations do not have sufficient scope to appropriately control the recent trend toward larger scaled, more complicated and urban forms of development which does influence the health, safety, and welfare of the City; and WHEREAS, the City Council of the City of Georgetown, Texas, hereinafter referred to as "Council". finds that said regulations must be revised in order to more appropriately govern the type of development being experienced by the City; and WHEREAS, the Council has determined that the adoption of this ordinance is imperative for the orderly and timely development of land under the jurisdiction of the City; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: Section 1e All the facts recited in the preamble to this ordinance are hereby found by the Council to be true and correct and are incorporated by reference herein and expressly made a part hereof, as if copied herein verbatim. Section 2. That a certain document entitled "Subdivision Regulations of the City of Georgetown, Texas" and dated January 19, 1988 which is attached hereto and made a part of this ordinance for all purposes is hereby adopted by the City* Section 3. The subdivision regulations adopted by ordinance by the Council on May 10, 1977 and all subsequent amendments are hereby repealed, and any other ordinance or provisions in conflict with the provisions hereof are hereby repealed to the extent of such conflict. Page 1 of 3 Section 4. Sunset Provision. Unless subsequent action extends the application and enforcement of the attached regulations, they shall expire two (2) years after the effective date of this ordinance. The Subdivision Regulations Advisory Committee, formed by Council Resolution Number 870442.00B on September 22, 1987 shall continue to exist and shall meet no less frequently than annually in the month of November to review the effect of these regulations and to recommend subsequent revisions to the attached regulations for the consideration of the Council. Section 5. Penalty_Clause. Any person or persons, firm or corporation, who shall violate any of the provisions of this article, or shall fail to comply therewith, or with any of the requirements thereof, shall be deemed guilty of an offense and, upon conviction, shall be liable for a fine not to exceed the sum of two hundred dollars ($200.00) including costs. Each day a violation shall be permitted to exist shall constitute a separate offense. Section 6. The City Secretary is hereby directed to publish the caption of this ordinance, at least one time within ten (10) days after final passage hereof, or as soon thereafter as possible in a newspaper in the City. The City Secretary shall also receive from and file an affidavit of such publication by the publisher of such newspaper taken before any officer authorized to administer oaths as evidence of such publication. The date of publication shall be the effective date of this ordinance. Section 7. If any section, paragraph, clause, phrase, or provision of this Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any remaining part or provision thereof, other than the part so declared to be invalid or unconstitutional.
