WHEREAS, the City of Georgetown (City") has heretofore adopted the National Electric Code ("Code") of regulations concerning electrical systems; and WHEREAS, it is the desire of the City Council of the City to adopt the updated version of the Code; and WHEREAS, the adoption of these updated Codes is required to facilitate inspection by the City officials of building and housing projects of construction within the corporate limits and extra -territorial jurisdiction of said City; and WHEREAS, the adoption of these Codes is necessary to the protection and maintenance of public safety, health and general welfare. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. Section 6-20 of Article II, Division I is hereby amended as follows: Section 6-20. Electrical Codes - Adopted. (a) In the installation, construction, erection, repair and maintenance of all electrical wiring and apparatus, the rules and the requirements of the National Electric Code, 1990 Edition, as published by the National Fire Protection Association as approved by the American Standards Association in force and effect at this time together with such requirements and rules as are provided herein, shall be complied with and become part of this code. SECTION 2: CONFLICTING PROVISIONS In the event any matters in the Codes adopted above are contrary or in conflict with existing ordinances of the CITY or those that may be adopted, the ordinance shall prevail and such existing parts of the Codes addressed above that are in conflict, are repealed to the extent of such conflict. SECTION 3: SEVERABILITY In case any one or more of the provisions contained in this Ordinance shall for any reason be held by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any respect, such invalidity, illegal- ity, or enforceability shall not affect any other provision herein, and this Ordinance shall be construed as if the invalid, illegal, or unenforceable provision had never been included. 0 SECTION 4: GRANDFATHER All electrical construction activity which has commenced prior to the effective date of the ordinance, the former code shall apply. Commencement of construction activity is construed as the actual date that the building permit is issued. SECTION 5: PUBLICATION AND EFFECTIVE DATE The City Secretary is hereby directed to publish this Ordinance,or its caption at least one time within TEN (10) days after final passage hereof or as soon thereafter as possible in a newspaper in the City of George- town, Texas. The City Secretary shall also receive from and file an affidavit of such publication by the publisher of such newspaper taken before any officer authorized to administer oaths as evidence of such publication.
