HomeMy WebLinkAboutORD 890402 - Capital Recovery Fee Creditsje AN ORDINANCE REPEALING THE CAPITAL RECOVERY FEE ORDINANCES INCORPORATED AS ARTICLE V, SECTION 23-81 ET.SEQ.,• AND MAINTAINING CAPITAL RECOVERY FEE CREDITS. WHEREAS, the City Council of the City of Georgetown, Texas, has adopted the following ordinances which provide for the assessment of capital recovery fees for water and wastewater service: 84-03 and 84-04 on January 10, 1984; 84-07 on January 23, 1984, and 86-45 on September 23, 1986, and WHEREAS, these capital recovery fee Ordinances are incorporated under Article V, Sections 23-81, et.seq. of the Georgetown Code of Ordinances; and WHEREAS, the City Council finds that capital recovery fees collected by the City have decreased significantly over the past several years; and WHEREAS, the City Council adopted the Strategic Plan for Economic Development on July 11, 1989, and said Plan commits the City to activities which will attract commercial and industrial development, and WHEREAS, the City Council finds that repealing the capital recovery fee Ordinances will reduce the overall cost of development in Georgetown; and WHEREAS, the City Council finds that this action implements the Strategic Plan for Economic Development, as well as Economic Development Policy 1; Growth and Physical Development Policy 4! and Utilities Policy 5 of the Century Plan - Policy Plan Element; and is not found to be inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: Section One. All of the facts recited in the preamble to this Ordinance are hereby found by the City Council to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Section Two. 1) Ordinances 84-03, 84-041 84-07, and 86-45 are hereby repealed. 2) All capital recovery fees previously collected shall continue to be used in the manner for which they were intended. 3) All entities with prior agreements with the City for capital recovery fee credits shall be entitled to those credits in accordance with said agreements.
