AN ORDINANCE PROVIDING FOR THE REDUCTION OF CERTAIN
BOUNDARY LIMITS OF THE CITY OF WEIR, TEXAS, THROUGH THE
DISANNEXATION OF CERTAIN TERRITORY CONSISTING OF,
APPROXIMATELY 127.52 ACRES, MORE OR LESS, BEING A PART
OF THE TOWN OF WEIR, WILLIAMSON COUNTY, TEXAS,
ACCORDING TO THE PLAT OF THE TOWN OF WEIR AS
INCORPORATED, AND FOUND OF RECORD IN WILLIAMSON COUNTY,
TEXAS, AND IS A PART OF AN ORDER ESTABLISHING THE
INCORPORATION OF THE TOWN OF WEIR FILED OF RECORD IN
VOLUME 1574, PAGE 253, OFFICIAL RECORDS OF WILL•IAMSON
COUNTY, TEXAS, WHICH PROPERTY IS MORE FULLY DESCRIBED
HEREIN; PROVIDING FOR CITY APPROVAL OF THE BOUNDARY
LINE FOR THE EXTRA -TERRITORIAL JURISDICTION BETWEEN THE
CITIES OF GEORGETOWN, TEXAS, AND WEIR, TEXAS, AS
DESCRIBED IN THE FEBRUARY 19, 1988, AGREEMENT BETWEEN
THE 14AYORS OF THE CITIES; PROVIDING FOR A VALIDATION
AND SAVINGS CLAUSE.
WHEREAS, Section 43.144 of the Texas Local Government Code
provides that a mayor and governing body of a general law muni
cipality by ordinance may discontinue an area as part of the
municipality if the area consists of at least ten (10) acres
contiguous to the municipality and the area contains fewer than
one (1) occupied residence or business structure for every two
(2) acres and fewer than three (3) occupied residences or busi-
ness structures on any one (1) acre; and
WHEREAS, the City of Weir desires to disannex 127.52 acres
of land, more or less, being a part of the Town of Weir. more
fully and accurately described in field notes attached hereto
as Exhibit "A" and incorporated by reference herein, which
acreage is more than ten (10) acres and contains fewer than one
(1) occupied residence or business structure for every two (2)
acres and fewer than three (3) occupied residences or business
structures on any one (1) acre; and
WHEREAS, it is deemed in the besr interest of the City of
Weir that such property be disannexed as a part of the corporate
limits of the City of Weir; and
WHEREAS, the mayors of the Cities of Georgetown, Texas, and
Weir, Texas, signed an Agreement on February 19, 1988, defining
the extra -territorial and corporate boundaries between the
cities; and
WHEREAS, the current extra -territorial boundaries of the
City of Weir does not correspond with the extra -territorial
boundary described in the Agreement; and

WHEREAS, under Section 42.023 of the Texas Local Government
Code, the City of Weir desires to reduce its extra -territorial
boundary to conform and comply with the Agreement with
Georgetown.
NOW, THEREFORE, be it ordained•by the City Council of the
City of Weir, Texas:
SECTION I.
All of the facts recited in the preamble to this ordinance
are hereby found by the Council to be true and correct, and are
incorporated by reference herein and expressly made a part
hereof, as if copies herein verbatim.
SECTION II.
The following described land and territory lying within the
City of Weir, Texas, is hereby disannexed from the City of Weir,
Texas, and said territory hereinafter described shall
hereinafter be excluded from the boundary limits in the City of
Weir, Texas, and the present boundary limits of the City of
Weir, Texas, at the various points contiguous to the area
hereinafter described are altered and amended so as to exclude
the area from the corporate limits of the City of Weir, Texas,
to -wit: BEING the tract and parcel of land of approximately
127.52 acres described in Exhibit "A" attached hereto and incor-
porated by reference herein for all purposes.
SECTION III.
The City of Weir, Texas, hereby agrees to relinguish and
reduce any of its extra -territorial jurisdiction west of that
certain line described as the dividing line in the aforemen-
tioned Agreement. The extra -territorial relinguished and
reduced by the City of Weir, Texas, is included in the property
described in Exhibit "B" attached hereto and incorporated by
reference herein for all purposes.
SECTION IV.
If any section, paragraph, clause, phrase or provision of
this ordinance shall be adjudicated invalid or held unconstitu-
tional, the same shall not effect the validity of this ordinance
as a whole or any part or provision thereof other than the part
so declared to be invalid or unconstitutional.

BEING 127.52 acres, more or less, in Williamson County, Texas, about
7...07 acres of the Samuel Nimmo League, Abstract No. 481, and about
48.45 acres lying in the W. Stubblefield Survey, Abstract No. 556.
This tract contains part of a 10622 acre tract and ail of a 106 acre
tract which are described in an Order Establishing the Incorporation
of the Town of Weir, as filed in Vol. 1574, Pg. 253 of the official
records of Williamson County, Texas.
BEGINNING at the apparent Southwest corner of the old Bethel Nowlin
60.8 acre tract, in the North line or Highway'220, and in the
approximate center of the San Gabriel River. This point being the
Southwest corner of the said 106 acre tract.
THENCE upstream with the approximate centerline of the San Gabriel
River, N 48 deg. W 650 feet, N 60 deg. W 1150 feet, N 75 deg. W 2100
feet, N 60 deg. W 800 feet, N 30 deg. W 350 feet, N 03 deg. W 13SO
feet, N 05 deg. W 6SO feet, and N 34 deg. 39 min. 25 sec. E 634.5
feet to the common West corner between the said 106 acre tract and
the 1062 acre tract.
THENCE upstream with the approximate centerline of the San Gabriel
