HomeMy WebLinkAboutORD 890192 - Canvass ReturnsORDINANCE N0. , )`T:, AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE CITY OF GEORGETOWN GENERAL ELECTION ON MAY 6, 1989; AND PROVING FOR EMERGENCY PASSAGE WHEREAS, the City Council of the City of Georgetown, Texas ordered an election to be held on Saturday, May 6, 1989 for the purpose of electing the following officials for this City: Five (5) members of Council, District Nos. 1 - 5; and WHEREAS, the Charter of the City of Georgetown, Texas provides that the Councilmembers elected in 1989 shall draw lots to determine which one (1) of them shall serve a one (1) year term of office; and WHEREAS, the City Council has investigated all matters pertaining to said election, including the ordering, giving notice, holding and making returns of said election; and WHEREAS, the election officers who held said election have duly made the returns of the results thereof, and said returns have been duly delivered to said City Council; and WHEREAS, it appears from said returns, duly and legally made, that there were cast at said election 2 valid and legal votes* that each of the candidates received the following votes: DISTRICT NO. 1: Lorenzo L. Valdez, Jr." Write -Ins DISTRICT NO. 2: Winfred Bonner ,, `f Write -Ins C, DISTRICT NO. 3: Barbara Pearce l`q Write -Ins DISTRICT NO. 4: Mike McMaster 14 Luther Laubach Write -Ins 05/09/89 ----- election canvass ord ----- page 1 of 3 DISTRICT NO. 5: Joe Saegert8:• Jack Woods Write -Ins WHEREAS, the City Council of the City of Georgetown has determined that this ordinance must be passed on an emergency reading to allow the Councilmembers to take office in a timely manner, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS that: Section I. The City Council officially finds and determines that said election was duly called; that proper notice of said election was given in accordance with law; that said election was held in accordance with law; and that returns of the results of said election have been made and delivered, and that the City Council has canvassed said returns, all in accordance with the law and the Ordinance calling said election. Section II. The City Council officially finds and determines that f�irC1) 0°(4'ACf F, J, was elected as Councilmember for District No. 1;w - was elected as Councilmember for District No. 2,� was elected as Councilmember for District No. 3;4, t�t was elected as Councilmember for District No. 4.; andI was elected as Councilmember for District No. 5; and furthermore', said parties are hereby declared duly elected to said respective offices, subject to the taking of their oaths of office as provided for by the laws of the State of Texas and the Charter of the City of Georgetown, Texas. Section III. The City Secretary shall conduct a drawing after the Councilmembers from District Nos. 1 - 5 take their oath of office to determine which councilmember shall serve a one (1) year term of office; the remaining councilmembers from these districts shall serve a two (2) year term of office. Section IV. It is further found and determined that in accordance with the order of this governing body, the City Secretary posted written notice of the date, place and subject of this meeting on the bulletin board located outside of City Hall and the Council Chambers, a place convenient and readily accessible to the general public, and said notice having been so posted and remaining posted and continuously for at least 72 hours preceding the scheduled time of said meeting. A copy of the return of said posting shall be attached to the minutes of this meeting and shall be made a part thereof for all intents and purposes. Section V. 05/09/89 ----- election canvass ord ----- page 2 of 3 This Ordinance establishes an emergency due to the need for these Councilmembers to take office timely in accordance with the provisions of the Election Code of the State of Texas and the Charter of the City of Georgetown and therefore shall take effect immediately upon passage by a favorable vote of not less than a majority plus one of the councilmembers qualified in serving.
