I qo ORDINANCE REPEALING SECTION 10-1, "PAYMENT OF CLAIMS FOR EQUIPMENT, ETC., CHAPTER 10 "FINANCE" BY ADDING A NEW SECTION, 10-1 FOR FILING CLAIMS FOR DISPUTED BILLS; REPEALING SECTION 10-22 "CONTRACTS FOR PUBLIC IMPROVEMENTS", CHAPTER 10, "FINANCE" OF THE CODE OF ORDINANCES OF THE,CITY OF GEORGETOWN TEXAS BY ADDING A NEW SECTION 10-2 to CHAPTER 10 AUTHORIZING THE CITY MANAGER TO CONTRACT FOR EXPENDITURES LESS THAN $51000.00; AND ADDING A NEW SECTION 10-3 "FACSIMILE SIGNATURE AUTHORITY" TO CHAPTER 10 "FINANCE" TO PROVIDE FOR MACHINE FACSIMILE SIGNATURE AUTRORITY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE WHEREAS, the City it necessary and proper Equipment, etc." of Chapter the City of Georgetown, new section relating to Council of the City of to repeal Section 10-1, 10, "Finance", of Texas, in its entirety provisions of the City Georgetown, Texas deems "Payment of Claims for the Code of Ordinances of and replace it with a Charter Sec. 9.07 for the processing of', claims against the City; and WHEREAS, the City Council also finds it necessary to repeal Section 10-2, "Contracts for Public Improvements" of Chapter 10, "Finance", of the Code of Ordinances of the City of Georgetown, Texas, in its entirety; and WHEREAS, the City Charter of the City of Georgetown, Texas, provides the City Manager with the authority to contract for expenditures without further approval of the City Council for all budgeted items not exceeding $5,000.00, when an ordinance is adopted and the Council desires to adopt the same; WHEREAS, Chapter 6.07 of the City of Georgetown Charter provides that the Council, under such regulations and limitations as it may prescribe, may by ordinance authorize the use of machine -imprinted facsimile signature of the City's Mayor and City Manager on checks, vouchers or warrants for the withdrawal of money from the City depositories; and WHEREAS, the City of Georgetown City Council, wishes to provide such authorization for the use of such facsimile signatures of both the Mayor and City Manager, and WHEREAS, the City of Georgetown City Council wishes to repeal in its entirety Ordinance 82-19 which authorizes the use of a facsimile signature of either the Mayor or the City Manager, NOW THEREFORE, BE RESOLVED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS that: I. I 1 I ---- FINANCE ORD AMEND page 1 of 3 SECTION I. The City Council finds that the recitals set forth in the preamble of this ordinance are true and correct and.are adopted herein. SECTION II. The City of Georgetown, Texas Code of Ordinances Section 10-1 "Payment of Claims for Equipment, etc." of Chapter 10 entitled "Finance" is hereby repealed in its entirety and a new Section 10-1 shall read as follows: .r,Sec. 10-1. Payment of claims for equipment, etc. All disputed claims against the City for unpaid invoices, bills, etc. that are due and owing for equipment, supplies, materials or services shall be made in the same manner as provided in Section 9.07 of Article IX, "General Provisions" of the City Charter. SECTION III. The City of Georgetown, Texas Code of Ordinances Section 10-2 "Contracts for Public Improvements" of Chapter 10 entitled "Finance" is hereby repealed in its entirety and a new Section 10-2 shall read as follows: I Sec. 10-2. Authority of City Manager to Contract. The City Manager is authorized to contract for expenditures for budget items in amounts not to exceed five thousand dollars ($5,000.00). SECTION IV. Ordinance 82-19 is repealed in its entirety. SECTION V. The City of Georgetown, Texas Code of Ordinances Section 10-3 entitled "Facsimile Signature Authority" is hereby added to Chapter 10, "FINANCE" as follows: .. Sec. 10-3. Facsimile Signature Authority. The use of machine -imprinted facsimile signatures of the City's Mayor and City Manager on checks, vouchers or warrants for the withdrawal of money from the City's depositories is hereby authorized. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence or part of this ordinance or the application of same to any person or circumstance shall -for any reason by adjudged invalid or held unconstitutional, by a court of competent jurisdiction, it shall not-aff-ect, impair, .or invalidate the remainder of this ordinance which shall be given full force and effect. SECTION VII. If any ordinance, resolution, policy or procedure is in conflict or inconsistent with the terms, conditions, or provisions of this ordinance, then the same is hereby repealed to the extent of any conflict or inconsistency. SECTION VIII. This ordinance shall become effective immediately upon passage and second reading of the City Council of the City of Georgetown, Texas.
