AN ORDINANCE AMENDING ARTICLE I, SECTION 23-2 (d) "SATISFACTORY
PAYMENT HISTORY DEPOSIT REFUND"; ARTICLE I, SECTION 23-2 (e)
"DEPOSIT NOT REQUIRED AFTER A SATISFACTORY PAYMENT HISTORY"; AND
ARTICLE I. SECTION 23-2 (f) "DEPOSIT REQUIRED AFTER TERMINATION"
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Georgetown, Texas deems
it necessary to amend Article I, Section 23-2 (d) "Satisfactory payment
history deposit refund" to provide for a one year period of satisfactory
payment and redefine satisfactory payment; Article I, Section 23-2 (e)
"Deposit not required after a satisfactory payment history" to provide a
one year period of satisfactory payment in order to refund deposit; and
Article I, Section 23-2 (f) "Deposit required after termination1° to
provide a one year period for satisfactory payment in order to refund
deposit;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS:
SECTION I.
That the City Council finds that the recitals set forth in the preamble of
this ordinance are true and correct and are adopted herein.
SECTION II.
That the City of Georgetown Code of Ordinances, Chapter 23, Section 23-2
(d) "Satisfactory payment history deposit refund" is hereby amended to read
as follows:
"(d) Satisfactory payment history deposit refund. The required
utility deposit shall be refunded to a utility customer after one
(1) year of satisfactory payment history for utility services.
Satisfactory payment history is defined as a payment history that
does not include any charge of a ten percent (10%) penalty for
non-payment by the due date, as provided in Section 23-1 (g)
"Payment and Collection"."
SECTION III.
That the City of

SECTION IV.
That

11(f) Deposit required after termination. Unless already posted,
a utility deposit, as required by this section, shall be posted
by any utility customer, regardless of payment history, if
utility service has been discontinued for nonpayment. Utility
customers shall thereafter be entitled to a satisfactory payment
history deposit refund upon the completion of the required
one-year satisfactory payment history, as computed from the date
of reconnect, in accordance with the provisions of this section."
SECTION V.
In the event any section, paragraph, subdivision, clause, phrase, provision
sentence or part of this ordinance or the application of same to any person
or circumstance shall for any reason be adjudged invalid or held unconsti-
tutional, by a court of competent jurisdiction, it shall not affect,
impair, or invalidate the remainder of this ordinance which shall be given
full force and effect.

If any ordinance, resolution, policy or procedure is in conflict or
inconsistent with the terms, conditions or provisions of this ordinance,
then the same is hereby repealed to the extent of any conflict or
inconsistency.
SECTION VI.
This ordinance shall become effective immediately upon adoption by the City
Council of the City of Georgetown, Texas.
