ARTICLE III OF THE CITY OF GEORGETOWN, TEXAS CODE OF ORDINANCES
ENTITLED "FOOD SANITATION", BY SPECIFICALLY AMENDING SECTION
12-33, "APPLICATION AND FEES"
WHEREAS, the Williamson County Health Department (the
"Department") is the agency that has the authority to issue permits for
all food establishments within the City of Georgetown, Texas; and
WHEREAS, the Department has experienced serious fiscal shortfalls
during the 1987 and 1988 fiscal years, and
WHEREAS, the Department has intended for the Food Sanitation
Surveillance Program to be totally self-sufficient, supported entirely
by fees generated by surveillance activities, and
WHEREAS, current fee levels have not achieved the
self-sufficiency goal and the Department finds it necessary to
restructure the Food Purveyor Permit fee levels so that they will be
determined by business volume,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS that:
SECTION I.
The City Council adopts the recitals set forth above as true and
correct and the same are adopted herein verbatim as if fully set forth
at length.
SECTION II.
Ordinance No. 85-38 and Chapter 12, Article III of the City of
Georgetown, Texas Code of Ordinances entitled "Food Sanitation" is
hereby amended by specifically amending Section 12-33 "Application and
Fees" to read as follows.
"Sec. 12-33. Application and Fees.
Under the terms of this article, every person who may desire to
operate a food establishment in the City shall make application to the
Health Department, upon forms prescribed and furnished by the Health
Department for a permit. Upon filing of such application, the Health
Official shall make or cause to be made an inspection of the premises,
and [upon finding that] the conduct of such business comes within the
requirements of this article, the Health Official shall approve such
application, whereupon the applicant shall pay an applicable fee
according to the following schedule:

which conduct business between January 1 and
pay the full fee. Establishments which do
after July 1, will be required to pay only
(c) Every such permit shall be nontransferable, shall permit the
operation of a food establishment only at the location for which
granted and shall expire at midnight on the 31st day of December of the
calendar year in which the permit is issued.
SECTION III.
This Ordinance shall become effective upon adoption of its second and
final reading by the City Council of the City of Georgetown, Texas and
its publication within ten (10) days after adoption.
SECTION IV.
All ordinances, resolutions and/or parts of ordinances and resolutions
in conflict herewith are hereby repealed and rescinded to the extent
of any such conflict.
PASSED AND APPROVED on First Reading this the day of
1988 by a vote of "AYES" and "NOS" with
Councilmembers present and voting.

conspicuous
place in the
food service area of the food
establishment
at all times.
SECTION III.
