CODE OF ORDINANCES; PROVIDING A SEVERABILITY CLAUSE, AND SETTING AN EFFECTIVE D. WHEREAS, the City of Georgetown contracted with the Book Publishing Company, Seattle, Washington, to compile, edit and publish a codification of the permanent and general ordinances of the City of Georgetown, Texas; and WHEREAS, there is now on file in the office of the City Secretary, for public inspection, a document entitled "Georgetown Municipal Code," known for all intents and purposes as the City of Georgetown "Code of Ordinances". NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ! ! THAT. Section 1. Adoption. There is hereby adopted the "Georgetown Code of Ordinances", to be treated as a new and original comprehensive ordinance superseding all other previously adopted versions of the Georgetown Code of Ordinances. Section 2. Title -Citation -Reference. This code shall be known as the "City of Georgetown Code of Ordinances" and it shall be sufficient to refer to said code as the "City of Georgetown Code of Ordinances" in any prosecution for the violation of any provision thereof or in any proceeding at law or equity. It shall be sufficient to designate any ordinance adding to, amending, correcting or repealing all or any part or portion thereof as an addition to, amendment to, correction or repeal of the "Georgetown Code of Ordinances." Further references may be had to the titles, chapters, sections and subsections of the"Georgetown Code of Ordinances," and such references shall apply to that numbered title, chapter, section or subsection as it appears in the code. Section 3. Reference Applies to All Amendments. Whenever a reference is made to this code as the "Georgetown Code of Ordinances" or to any portion thereof, or to any ordinance of the City of Georgetown, codified herein, the reference shall apply to all amendments, corrections and additions heretofore, now or hereafter made. Section 4. Title, Chapter and Section Readings. Title, chapter and section headings contained herein shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or intent of the provisions of any title, chapter or section hereof. Section 5. Reference to Specific Ordinances. The provisions of this code shall not in any manner affect matters of record which refer to, or are otherwise connected with ordinances which are therein specifically designated by number or otherwise and which are included within the code, but such reference shall be construed to apply to the corresponding provisions contained within this code. Section 6. Effect of Code on Past Actions and Obligations. The adoption of this code does not waive any fee or penalty due and unpaid on the effective date of this code; does not affect the validity of any bond or cash deposit posted, filed or deposited pursuant to the requirements of any ordinances; and does not affect the prosecution of any offenses currently pending in municipal court. Section 7. Constitutionality. If any section, subsection, sentence, clause or phrase of this code is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this code. Section 8. Severability. If any section, paragraph, clause, or provision of this ordinance shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause, or provision shall not affect any of the remaining provisions of this ordinance. Section 9. Effective Date. This ordinance shall become effective and be in full force and effect immediately following second reading and passage by the City Council and when duly signed by the Mayor and attested by the City Secretary, PASSED AND APPROVED on First Reading on the 27th day of November, 1990, PASSED AND APPROVED on Second and Final Reading on the 11th day of December, 1990, Approved as to Form: Marianne Landers Banks, City Attorney Attest: Elizabeth Gray, City Code Ordinance/Page 2 of 2
