AN ORDINANCE AMENDING SECTION 22-43 OF THE CODE OF ORDINANCES REGARDING NO PARKING ZONES OF ARTICLE III, "PARKING", CHAPTER 22 OF THE GEORGETOWN CODE OF ORDINANCES; PROHIBITING PARKING AROUND THE JUSTICE CENTER AND ADJOINING STREETS; DIRECTING THE CITY MANAGER TO ERECT APPROPRIATE SIGNS INDICATING SUCH ZONES; REPEALING SECTION 22-43.1 OF THE CODE OF ORDINANCES REGARDING PARKING IN NO PARKING ZONES DURING CERTAIN HOURS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR PUBLICATION AND SETTING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Georgetown, Texas, deems it necessary and proper to amend Sec 22-43, "No Parking Zones - At all Times" of Chapter 22, "Traffic", of the Code of Ordinances of the City of Georgetown, Texas to include additional streets for regulating parking zones, and WHEREAS, the Council finds that it is necessary and proper and in the best interest of the citizens of Georgetown to adopt the changes hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY ordinance OF true GEORGETOWN, herein verbatim as if fully set forth at length. TEXAS, that: SECTION I. The City Council finds that the recitals set forth in the preamble of this ordinance are true and correct and are adopted herein verbatim as if fully set forth at length. SECTION II. Section No. 22-43 of the Code of Ordinances be amended to read. "Section 22-43. No Parking Zones - At All Times (a) Prohibited Act. It shall be unlawful for any person to park any vehicle upon any street or portion of a street which is designated by this section as a no parking zone. (b) Signage. Each no parking zone shall be designated by a sign stating "No Parking Anytime". (c) No Parking Zones Designated. In addition to all no parking zones appropriately designated prior to the effective date of this ordinance, the following specific streets and portions of streets are designated as no parking zones: U.S. 81/Loop 418 (Austin Avenue) - the entire length within the City limits, except those spaces designated for parallel parking from the South curb line of West Sixth (6th) Street South to the North curb line of West Ninth (9th) Street; State Highway 29 (University Avenue) - the entire length within the City limits; F.M. 2338 (Williams Drive) - the entire length within the City limits; Martin Luther King St. - along the East curb line of Martin Luther King to a point at which the North curb line of West Fourth (4th) Street would intersect with the East curb line of Martin Luther King Street to the North curb line of West Sixth (6th) (400 and 500 blocks of Martin Luther King Street); Rock Street - along the East curb line of Rock Street from the North curb line of West Sixth (6th) Street to the South curb line of West Fourth (4th) Street, and along the West curb line of Rock Street from the North curb line of West Sixth (6th) Street to a point one hundred and twenty (120) feet North of the North curb line of West Fifth (5th) Street; West Sixth (6th) Street - along the North and South curb lines of West Sixth Street from the West curb line of Rock Street to the East curb line of Martin Luther King Street (300 and 400 blocks of West Sixth (6th) Street); F.M. 2243 (Leander Road) - the entire length within the City limits. SECTION III. The City Manager is hereby directed to have installed appropriate signs to indicate the no parking zones contained in this ordinance. SECTION IV. Section No. 22-43.1 of the Code of Ordinances is hereby repealed. SECTION V. If any ordinance, resolution, policy or procedure is in conflict or inconsistent with the terms, conditions, or provisions of this ordinance, then the same is hereby repealed to the extent of any conflict or inconsistency. SECTION VI. In the event any section, paragraph, subdivision, clause, phrase, provision, sentence or part of this Ordinance or the application of the same to any person or circumstance shall for any reason be adjudged invalid or held to be unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or invalidate the remainder of this ordinance which shall be given full force and effect. SECTION VII. Upon final passage the City Secretary shall cause this ordinance's caption to be published in the newspaper of general jurisdiction and this ordinance shall become effective 10 days after its publication. READ AND APPROVED on first reading this 12th day of June, 1990 by a vote of 7 "ayes" and 0 "noes" with 7 Councilmembers present and voting.
