RDINANCE NUMBER
AN ORDINANCE ADOPTING THE DEVELOPMENT PLAN AS THE LAND
INTENSITY, TRANSPORTATION, AND UTILITIES FUNCTIONAL PLAN
ELEMENTS OF THE CENTURY PLAN PURSUANT TO SECTION 1.08 OF
THE CITY CHARTER; DEFINING THE FORCE AND EFFECT THEREOF;
AMENDING CHAPTER 19 1/2 "COMPREHENSIVE PLAN" OF THE CODE
OF ORDINANCES OF THE CITY OF GEORGETOWN; AMENDING
APPENDIX C. "GEORGETOWN CENTURY PLAN" OF THE CODE OF
ORDINANCES OF THE CITY OF GEORGETOWN AND SETTING AN
EFFECTIVE DATE.
WHEREAS, the City Charter of the City of Georgetown was
amended by vote of the people in April 1986 such that
comprehensive planning was established as a continuous and
ongoing governmental function; and
WHEREAS, said City Charter now states that a revised
comprehensive plan containing the City Council's policies for
growth, development, and beautification of land within its
jurisdiction shall be adopted by April 1988; and
WHEREAS, the City Council did, on March 8, 1988, adopt the
Georgetown Century Plan Policy Plan as the Comprehensive Plan for
the City pursuant to Section 1.08 of the City Charter; and
WHEREAS, the City Charter, Section 1.08, Subsection 2,
requires that the comprehensive plan "include, but not be limited
to a future land -use element, a traffic circulation and public
transit element; [and] a wastewater, electric, solid waste,
drainage and potable water element. . ", and
WHEREAS, the City Council did on January 26, 1988, adopt
Resolution #880027 authorizing and directing the Century Plan
Steering Committee and Task Group I to develop the Land Use,
Transportation, and Utilities Functional Plan Elements of the
Century Plan, and
WHEREAS, the Century Plan Steering Committee and Task Group
I, which together became known as the Century Plan Working Group,
did meet from January 1988 to January 1990 and did create the
Century Plan - Development Plan, and
WHEREAS, the Century Plan Working Group held a public
workshop on the Development Plan on November 30, 1989, to present
the Development Plan to the public, and
WHEREAS, the Century Plan Working Group did present the
Development Plan to the City Council in a workshop held on
January 23, 1990, and
WHEREAS, the City Council did hold a Public Hearing on the
Century Plan - Development Plan on February 13, 1990, and
WHEREAS, the City Council finds that this action implements
Environmental and Resource Conservation Policies 1 and 2;
Facilities and Services Policy 1; Growth and Physical Development
Policies 1, 21 4, and 5; Transportation Policies 1 and 2; and
Utilities/Energy Policies 2, 3, and 5s and the Industrial
Development, Commercial Development, and Community Development
Goals of the Strategic Plan for Economic Development. The City
Council further finds that this action is not inconsistent or in
conflict with any adopted Century Plan Policies or Goals, as
required by Section 2.03 of the Administrative Chapter of the
Policy Plan.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GEORGETOWN, TEXAS, THAT:
Section One.
All of the facts recited in the preamble to this Ordinance are
hereby found by the City Council to be true and correct, and are
incorporated by reference herein and expressly made a part
hereof, as if copied verbatim.
Section Two.
1) The document entitled "CENTURY PLAN - DEVELOPMENT PLAN, Land
Intensity, Transportation, and Utilities Functional Plan
Elements" dated November 15, 1989, which is made a part of
this Ordinance, shall from the effective date of this
Ordinance be the Land Use, Transportation, and Utilities
Functional Plan Elements of the Century Plan pursuant to
Section 1.08, Subsection 2 of the City Charter.
2) The entire document described above and known as the Century
Plan - Development Plan is hereby adopted as legally
binding.
3)
The Century
Plan -
Development Plan
shall be implemented in
accordance
with the
Administrative
procedures in Chapter
Four of the
Policy
Plan Element of
the Century Plan adopted
on March 8,
1988.
4) All future
development,
both public
and private, shall be in
conformity
with the
adopted Century
Plan - Development Plan.
5) Chapter 19 1/2, Comprehensive Plan "Century Plan", of the
Code of Ordinances of the City of Georgetown is hereby
amended by adding the following subsection.
Section 19 1/2, Subsection 3: Adoption of the Development
Plan, inclusive of the Land
Intensity, Transportation, and
Utilities Functional Plan
Elements
In accordance with Chapter 1.08, Subsection 2 of the
Georgetown City Charter, the City Council of the City of
Georgetown has adopted that certain document entitled the
"Georgetown Century Plan - Development Plan, Land Intensity,
Transportation, and Utilities Functional Plan Elements" for
the purposes of directing the City Council, staff, and
commissions in rendering actions and resolutions relating to
the utilization of all the available resources within the
City and its Planning Area for the purpose of developing
public and private land and serving that land with
infrastructure systems. This document, the same which may
be amended from time to time, is located in Appendix C of
the Georgetown City Code.
6) Appendix C, Georgetown Century Plan, of the Code of
Ordinances of the City of Georgetown is hereby amended by
adding the Century Plan - Development Plan.
7) The effective date of the Century Plan - Development Plan
shall be midnight of the date upon which this Ordinance is
approved upon final reading.
