HomeMy WebLinkAboutORD 900117 - Parade PermitsORDINANCE NO® 900117 AN ORDINANCE AMENDING CHAPTER 17, SUBSECTION (a) OF 17-6.1, "SAME - PERMIT REQUIRED; EXCEPTION" AND SUBSECTION (a) OF 17-6.3, "SAME ISSUANCE; STATEMENT OF TERMS, RESTRICTIONS" OF THE CITY OF GEORGETOWN CODE OF ORDINANCES TO PROVIDE FOR ADDITIONS AND DELETIONS, AND AMENDMENTS THERETO FOR PURPOSES OF CONFORMITY TO STATE LAW, EFFICIENCY IN MANAGEMENT AND OPERATIONS, AND COMPLIANCE WITH CURRENT PRACTICES OF THE CITY; PROVIDING FOR A SEVERABILITY CLAUSE, AND SETTING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Georgetown, Texas, has previously recognized that many provisions of the City Code are out-of-date, no longer appropriate for the current needs of the City, and, in certain circumstance, not in conformance with applicable law; WHEREAS, in light of this recognition, the City Council approved the process of recodification of the entire City Code, including addressing the obsolete provisions; WHEREAS, as a part of this review and process, the following items contained in the ordinance have been identified as those that need to be modified, added, or deleted as provided hereafter; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION I. The Council adopts the recitals set forth above as true and correct and are adopted herein verbatim as if fully set forth at length. SECTION II. That Subsection (a) of Section 17-6.1, "Same - Permit Required; Exceptions", of Chapter 17, "Offenses and Miscellaneous Provisions", is hereby amended as follows. (a) No person shall engage in, participate in, form or start any parade, street dance, block party, race, rally, concert, flea market, or any other activity requiring the closing or blocking off of any portion of any street, alley or sidewalk, or requiring the directing of traffic, unless a parade permit shall have first been obtained from the City Manager. 1 SECTION III. That Subsection (a) of Section 17-6.3, "Same ® Issuance, Statement of Terms, Restrictions", of Chapter 17, "Offenses and Miscellaneous Provisions", is hereby amended as follows. (a) The City Manager shall issue a parade permit, when from a consideration of the application and such other information as may otherwise by obtained, he finds that: (1) The conduct of the parade will not substantially interrupt the safe and orderly movement of other traffic, both vehicular and pedestrian; (2) The conducting of the parade will not require the diversion of so great a number of police officers as to prevent normal police protection for the city; (3) The conducting of such parade will not interfere with the movement of fire -fighting equipment to a fire; (4) The conducting of the parade is not reasonably likely to cause injury to persons or property, to provoke disorderly conduct, or create a disturbance, (5) The parade is not to be held for the sole purpose of advertising any product or goods and is not designed to be held purely for private profit, (6) The applicant has provided such general liability insurance coverage as may be required by the city manager and in the amounts as prescribed by the city manager. Such insurance, if any, shall name the city as an insured party. (7) The applicant has complied with any other special conditions imposed by the city or other authorized official, for the issuance of a parade permit. SECTION IV. All Ordinances, parts of Ordinances, or Resolutions in conflict herewith are expressly repealed to the extent of such conflict. SECTION V. If any article, provision, paragraph or part of a paragraph of this Ordinance is held to be invalid or unconstitutional by a court of 2 competent jurisdiction, the same shall not invalidate or impair the validity, force or effect of any other article, paragraph or part of a paragraph of the remainder of this Ordinance. SECTION VI. This Ordinance shall become effective upon Second Reading and Final Passage thereof. READ, PASSED AND APPROVED on First Reading this 1&k day of ` 1990.
