HomeMy WebLinkAboutORD 91-08 - Credit Card Processing FeeAN ORDINANCE OF OF CONFLICTINGOF GEORGETOWN, TEXAS, ADDING SECTION 4.24.030 "CREDIT CARD PROCESSING FEE REPEALING ORDINANCES AND RESOLUTIONS, INCLUDING A SEVERABILITY ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the Texas Legislature has authorized municipalities to collect a processing fee for collecting payments made by credit card, and WHEREAS, the City Council of the City of Georgetown wishes to provide the convenience of payment of a City fee, fine, court cost, or other charge by credit card provided the City Council has approved a contract with a third party processor credit card payments, and WHEREAS, the City Council has found that this action implements Finance Policy 1 of the Century Plan Policy Plan Element, "Conduct all municipal operations in an efficient, business -like manner ", and is not found to be inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THI CITY OF !' #THAT: The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. SECTION 2 The City of Georgetown Code of Ordinances is hereby amended by adding the following; "4.24.030 Credit Card Processing Fee. The Director of Finance and Administration is authorized to collect a credit card processing fee for the City's direct cost of providing collection by credit card of payment for any amount due the City. The City Council shall approve any contract with a third party processor of credit card payments. " OrdinanceCredit Card f All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable.
