HomeMy WebLinkAboutORD 91-35 - Amending DepositsORDINANCE No P I I IIIIIIIIiIla 111 111111 9 1111 1i 1;i _ :1 WHEREAS, Utility customers are refunded their utility deposits after twelve consecutive months of good payment history; and WHEREAS, Commercial utility customers with a twelve month good payment history who expand into a continuous space are unlikely to fail to maintain a current status on future utility bills; and WHEREAS, The City Council of the City of Georgetown wishes to allow such customers the ability to establish new utility service without the requirement to post the normal deposit; and WHEREAS, The City Council has found that this action implements Finance Policy 1 of the Century Plan - Policy Plan Element, which states: "The City will conduct all municipal operations in an efficient business -like manner" and Economic Development Policy 1 which states "The City will encourage diversified growth and promote business opportunities which create jobs, broaden the tax base and minimize the impact of economic fluctuations"; and WHEREAS, The City Council has found that this action is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF i ! SECTI®N 1 The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Deposit After A Satisfactory Payment History. Ordinancec`� Page 1 of 3 Paragraph E of Section 13.04.230 of the City of Georgetown Code of Ordinances relating to utility deposits is amended as follows: 13.04.230 Deposits E. Deposit After a Satisfactory Payment History. A utility deposit is not required from a former customer who has previously established a satisfactory payment history with the City during the most recent one-year period during which the customer was previously a customer of the City. A current customer opening an additional account must make the required deposit even though the current account may have a good payment history; however, a deposit is not required of a current commercial customer expanding an existing business into a contiguous space having separate meters, so long as that business has maintained aood ayment history for the twelve months prior to the time of expansion. SECTION 3 All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
