WHEREAS, Sec. 42.061 of the Election Code vests the authority to establish the election precincts for city elections in the city council; and WHEREAS, the currently established Election Precincts are found to have several problems associated with them, namely conflict with Mayfair celebrations, poor accessibility during Mayfair, inadequate parking, and displacement of the personnel and equipment responsible for the essential service of fire suppression; and WHEREAS, relocating the Election Precincts will provide greater accessibility to voters, convenient parking, and proximity to minority populations residing within the City limits; and WHEREAS, the Georgetown Independent School District experiences the same problems with regard to the current Election Precincts; and WHEREAS, the Georgetown Independent School District is in agreement with the need to relocate the Election Precincts; and WHEREAS, the Georgetown Independent School District has agreed to provide the use of their Administration Building as an Election Precinct for all City and GISD elections; and WHEREAS, the City Library is located in close proximity to the residents of Districts 1, 21 31 6, and 7, while the GISD Administration Building is located in close proximity to the residents of Districts 4 and 5; and WHEREAS, the unequal assignment of 5 Districts to Election Precinct One and 2 Districts to Election Precinct 2 is necessary for the greater convenience of the voters, particularly minority populations; and WHEREAS, the City Council has found that this action implements Governmental Affairs policies 1 and 2, of the Century Plan - Policy Plan Element, which state: "Pursue increased cooperation with all entities which provide services in the community", and "encourage all citizens to actively participate in governmental affairs"; and WHEREAS, the City Council has found that this action is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT. SECTION 1 The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. Election Precincts Ordinance No. J r _. j Page 1 of 2 SECTION 2 The City of Georgetown Library at 808 Martin Luther Ding is hereby designated as Election Precinct Number One, and will serve the voters of Council districts 1, 2, 3, 6, and 7. The Georgetown Independent School District Administration Building at 603 Lakeway Dr. is hereby designated as Election Precinct No. 2, and will serve the voters of Council Districts 4and 5. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4 If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5 The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
