OF THE ORIGINAL ORDINANCE, TO CHANGE ► PARCEL OUT OF THE CLEMENT STUBBLEFIELDSURVEY,ABSTRACT D 1 IN VOLUME 89 PA # OF DEED RECORDS OF WILLIAMSON COUNTY, TKVIAS, IN THE CITY OF GEORGETOWN, TEXAS, SAID PROPERTY BETNG LOCATED AT 2611 U.S. HIGHWAY 81 SOUTH AS MAPPED IN EXHIBIT A, FROM THE RS, SINGLE FAMILY RESIDENTIAL, D C2 -A, COMMERCIALFIRSTDISTRICT CLASSIFICATION; REPEALING ORDINANCES . 1. k. _ RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; l D ESTABLISHING 4, EFFECTIVE DATE, WHEREAS, an application has been made to the City Council for the purpose of changing the zoning district classification of the following described real property ("the Property "): A 2.43 ACRE PARCEL OUT OF THE CLEMENT STUBBLEFIELD SURVEY, DESCRIBED BY DEED IN VOLUME 789, PAGE 710 OF THE DEED RECORDS OF WILLIAMTSONCOUNTYTEXAS, IN HiCITYOF O i O •. SATID PROPERTY BEING tHIGHWAY 81 SOUTH hereiriafter referred to as 'the proper! WHEREAS, the City Council has submitted the proposed change in the Base Ordinance to the Planning and Zoning Commission for its consideration in a public hearing and for its recommendation or report; and WHEREAS, notice of such hearing was published in a newspaper of general circulation in the City, which stated the time and place of hearing, which time was not earlier than fifteen (15) days for the first day of such publication; and WHEREAS, written notice was given not less than fifteen (15) days before the date set for the meeting before the Planning and Zoning Commission to all the owners of the lots within two hundred feet of the property, as required by 1<lw; and VTHEREAS, the applicant for such zoning change paced on the Property such sign(s) as required by law for advertising the Planning and Zoning Commission hearing, not less than fifteen (15) days 'before the date set for such hearing; and WHEREAS, the City Planning and Zoning Commission in a meeting held on August b, 1991, recommended changing said zoning district classification of the above described Rezoning - 2611 So. U.S. 81 Page 1 of property from the RS SINGLE FAMILY RESIDENTIAL district to the C2 -A COMMERCIAL FIRST HEIGHT district zoning classification subject to the approval of a Detailed Development Plan prior to any construction on the site; and EREAS, the City Council has found that this action implements the following Policies of the Century Plan - Policy Plan Element: 1. Growth and Physical Development Policy #1 which states: 'The City will ensure that future land use patterns provide economic, cultural, and social activities to all residents, businesses and organizations "; 2. Growth and Physical Development Policy #2 which states: 'The City's regulatory actions will efficiently and effectively implement the Policy Statements and provide the opportunity to seek change with reasonable effort and expense '; 3. Growth and Physical Development Policy #4 which states: 'The City will encourage new developmen� and infill redevelopment in the community "; and 4. Environmental and Resource Conservation Policy # 1 which states: 'The City will take the steps necessary to protect the physical attributes that make Georgetown attractive "; and WHEREAS, the City Council has found that thio:, action is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS: The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. SECTION 2 The Base Ordinance and the Zoning Map of the City, as well as the Zoning District for the Property shall be and the same is hereby changed from the RS SINGLE FAMILY RESIDENTIAL district to the C2 -A COMMERCIAL FIRST HEIGHT district in accordance with thC field notes labeled Exhibit "A" which are attached hereto and incorporated by reference herein. Rezoning - 2611 So. U.S. 81 Page 2 of 3 SECTION 3 All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5 The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective immediately upon final passage in accordance with the provisions of the Charter of the City of Georgetown. BY DEED RECORDED IN VOLUME 789, PAGE 710 OF THE DEED _ECORDS OF WILLIAMSON COUNTY, TEXAS; AND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING at a 34" iron rod fourd on the east right-of-way line of U.S. Highway 81 (Austin Avenue) at the northwest corner of a 2 -acre tract as conveyed to Dr. Charles H. Aiken by deed recorded in Volume 4101, Page 307 of the Deed Records of, Williamson County, Texas, said iron rod found also, being the southwest corner of the above described Cen-Tex Explosives, Inc. 2.43 - acre tract, for the southwest corner and POINT OF BEGINNING of the herein 'described tract; THENCE, with the east right-of-way line of U.S. Highway 81 (Austin Avenue), the following two (2) courses. (1) N16027153"E a distance of 208.83 feet. to a broken concrete right-of-way monument found at an ang'_e point; and (2) N14035156"E a distance of 99..50 feet '.o a u" iron rod set at the southwest corner of Lot 1 Block A.
