HomeMy WebLinkAboutORD 91-01 - ANX Parker, Club, etcWHILEIREAS, the City Council of the City of Georgetown, Texas, may under the Charter of said City, Section 1.06, annex areas as allowed by State law; and AEREAS, notices of two (2) public hearings were published according to law in a newspaper having general circulation in the City of Georgetown, Texas, and in the herein described ter itory to be annexed not more than 20 days nor less than 10 days prior to those hearings; and �'1�IE.REAS, two public hearings by the City Council of the City of Georgetown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of certain tracts of land located in Williamson County, Texas, including the following tracts described in Exhibit A of this ordinance: 37.08 ACRES DESCRIBED AS TRACT 1 - PARKER TRACT, 3.65 ACRES DESCRIBED AS TRACT 2 - COUNTRY CLUB TRACT, 19.84 ACRES DESCRIBED AS TRACT 3 - RIVERIDGE FLOODPLAIN TRACT, 5.455 ACRES DESCRIBED AS TRACT 4 - MOTHERAL TRACT, AND 47.52 ACRES DESCRIBED AS TRACT 5 - BARNES TRACT; were held, the first being on the 23rd day of October, 1990, and the second hearing being on the 30th day of October, 1990; and V,FHEREAS, at such public hearings, a proposed service plan was presented to and discussed by the Council and all interested persons; and WHEREAS, such public hearings were held not more than forty (40) nor fewer than (20) days prior to the institution of these proceedings: and WHEREAS, the total corporate area of the City of Georgetown, Texas, on the lst day of January, 1990 was 9,141 acres; and HEREAS, the population of the City of Georgetown, Texas includes approximately, 16,000 inshabita.nts; and Page 1 of 16 WHEREAS, all of the herein -described property lies within the extra -territorial jurisdiction of the City of Georgetown, Texas; and WHEREAS, the herein -described property lies adjacent and contiguous to the City of Georgetown, Texas, and WHEREAS, the herein described property contains approximately 114 acres, and is not located within the incorporated limits of another City, or within the extra -territorial jurisdiction of another City, and WHEREAS, the annexation of the herein -described property is consistent with Century Plan Policy for Environmental and Resource Conservation to "take necessary steps to protect Georgetown's physical attractiveness"; and WHEREAS, the annexation of the herein -described property is consistent with Century Plan Policies for Growth and Physical Development to: "ensure that future land use patterns provide economic, cultural, and social activities to all residents, businesses and organizations"; and if efficiently and effectively implement the Policy statements through regulatory actions and provide reasonable opportunity for change;" and WHEREAS, all notices and other prerequisites of state law and the City Charter have been complied with; Section 1. All of the facts recited in the preamble to this ordinance are hereby found by the Council to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied herein verbatim. Section 2. The following described real property lying adjacent and contiguous to the City of Georgetown, Texas, is hereby added and annexed to the City of Georgetown, Texas, and said territory hereinafter described shall hereafter be included in the boundary limits of the City of Georgetown, 'Texas, and the present boundary limits of said City at the various points contiguous to the area hereinafter described are altered and amended so as to include said area within the corporate limits of the City of Georgetown, Texas, to -wit: BEING the following five tracts of land specifically described in Exhibit A attached hereto and incorporated herein by reference for all purposes: ACRES37.08 DESCRIBED AS TRACT ♦. • TRACT, ACRES3.65 ACRES DESCRIBED AS TRACT 2 - COUNTRY CLUB TRACT, 19.84 ACRES DESCRIBED AS TRACT 3 - RIVERIDGE FLOODPLAIN TRACT, 5.455 DESCRIBED a TRACT MOTHER t TRACT, 47.52 ACRES DESCRIBED ASTRACTBARNES TRACT Page 2 of 16 Section 3. The above-described real property and the area so annexed shall be a part of the City of Georgetown, Texas, and the property so added hereby shall bear its pro -rata share of the taxes levied by the City of Georgetown, Texas, and inhabitants thereof shall be entitled to all the rights and privileges of City residence, shall be bound by all such duties of citizenship and shall be bound by the acts, ordinances, resolutions and regulations of the City of Georgetown, Texas; furthermore, said tracts described in Exhibit A shall be served in accordance with the service plan described in Exhibit B attached hereto and incorporated by reference herein, which is hereby approved and adopted. Section 4. If any section, paragraph, clause, phrase, or provision of this Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so declared to be invalid or unconstitutional. ADKISSON GRET Page 15 of 16 Proposed Pian of Service for the Annexation Areas described in Exhibit A: Police Protection Upon annexation the Georgetown Police Department will provide regular and routine patrols of streets in the area as a part of its overall patrol activities. The department will respond to calls for assistance within their responsibility and jurisdiction. Fire Service Fire service is now being provided to the area and will continue to be provided by the present personnel and equipment of the fire fighting force. The City Code Enforcement Officer shall periodically patrol streets in the area to ensure that all properties are in conformance with City Code. Water Service -� The area is currently undeveloped, water lines will be extended in accordance with City policy if development of the area occurs. After installation, maintenance of City water facilities will be provided - in accordance with rates, terms, and conditions contained in she City Code. Sewer Service T he area is currently undeveloped, wastewater lines will be extended in accordance with City policy if development of the area occurs. Planning, and ZoJ nina The Planning and Zoning jurisdiction of the City will extend to this area on the effective date of annexation. The zoning will be A (Agricultural) unless requested otherwise and approved through regular procedures. Streets Streets will be maintained according to City Code and policy. Recreation, Library .Services No resident population exists, however, at such time in the future that a resident population does exist, recreation and library services will be provided to all residents of this tract in accordance with rates, terms and. conditions contained in the City Code.
