HomeMy WebLinkAboutORD 92-13 - Canvessing Runoff ElectionORDINANCE NO. 92-13 AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE CITY OF GEORGETOWN RUNOFF ELECTION HELD ON MAY 23, 1992; AND PROVIDING FOR EMERGENCY PASSAGE WHEREAS, the City Council of the City of Georgetown, Texas ordered a runoff election to be held on Saturday, May 23, 1992 for the purpose of electing Councilmember, District 2; WHEREAS, the City Council has investigated all matters pertaining to said election, including the ordering, giving notice, holding and making returns of said election; and WHEREAS, the election officers who held said election have duly made the returns of the results thereof, and said returns have been duly delivered to said City Council; and WHEREAS, it appears from said returns, duly and legally made, that each of the candidates received the following votes. DISTRICT NO. 2 Winfred Bonner Luther Laubach 68 63 WHEREAS, the City Council of the City of Georgetown has determined that this Ordinance must be passed on an emergency reading to allow the Councilmembers to take office in a timely manner, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN TEXAS, that: SECTION 1. The City Council officially finds and determines that said election was duly called; that proper notice of said election was given in accordance with law; that said election was held in accordance with law; and that returns of the results of said election have been made and delivered, and that the City Council has canvassed said returns, all in accordance with the law and the Ordinance calling said election. SECTION H. The City Council officially finds and determines that Winfred Bonner was elected as Councilmember, District 2. Furthermore, said party is hereby declared duly elected to said office, subject to the taking of his oath of office as provided for by the laws of the State of Texas and the Charter of the City of Georgetown, Texas. 1992 Runoff Election Canvass Ordinance No. 92-13 Page 1 of 2 SECTION III. It is further found and determined that in accordance with the order of this governing body, the City Secretary posted written notice of the date, place and subject of the meeting on the bulletin board located outside of City Hall and the Council Chambers, a place convenient and readily accessible to the general public, and said notice having been so posted and remaining posted and continuously for at least 72 hours preceding the scheduled time of said meeting. A copy of the return canvassed as part of said posting shall be attached to the minutes of this meeting and shall be made a part thereof for all intents and purposes. SECTION IV. This Ordinance establishes an emergency due to the need for these Councilmembers to take office in a timely fashion and in accordance with the provisions of the Election Code of the State of Texas and the Charter of the City of Georgetown and therefore shall take effect immediately upon passage by a favorable vote of not less than a majority plus one of the Councilmembers qualified in serving. PASSED, APPROVED, AND ADOPTED on emergency reading on this 26th day of May, 1992.
