WHEREAS, a number of festivals, events and parades are held throughout the year on
and adjacent to the downtown square;
WHEREAS, the City Council of the City of Georgetown, Texas, finds it necessary, proper
and in the best interest of the citizens of Georgetown to prohibit the possession or use of glass
bottles and containers in the downtown square area immediately adjacent to the square during
parades, festivals and special events;
WHEREAS, in the preservation of public health, safety and welfare of the citizens of
Georgetown, there exists the need to implement this ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE C
OF i' i THAT:
SECTION 1. The facts and recitations contained in the preamble of this ordinance are
hereby found and declared to be true and correct, and are incorporated by reference herein and
expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this
ordinance implements Facilities and Services Policy 1 of the Century Plan - Policy Plan Element,
which states: "The City will endeavor to increase the quality of life through the upgrading of
existing facilities and services and the provision of new services to meet the specific needs of
the community", and further finds that the enactment of this ordinance is not inconsistent or in
conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative
Chapter of the Policy Plan.

SECTION 2. Chapter 12.24, Section 12.24.010 of the Code of Ordinances of the City
of Georgetown, Texas is hereby amended to read as follows:
"12.24.010 Definitions.
For the purposes of this chapter, the following words and phrases shall have the
meanings respectively ascribed to them in this section:
"Parade" means any parade, march or procession of any kind or any similar
display consisting or 50 or more persons or 25 or more vehicles or 25 or more beasts of
burden in or upon any public street, alley or sidewalk in the City. "Parade" specifically
includes any street dance, race, rally, concert, flea market, block party or other similar
activity occurring upon any public street, alley, or sidewalk in the City' and similar events
held on property adjacent to such streets, alleys and sidewalks when such activity requires
the closing of said public ways or creates an undue traffic hazard.
"Festival" means a period or program of festive activities, cultural events, or
entertainment.
"Special Event" means a gathering
which is determined by the City Manager

"Parade Permit" means a permit as required by Section 12.24.020.
"Downtown Square and Adjacent Area" means all open/public areas within the
following boundaries, the area around the square beginning at the western point of the
northern building line of Sixth Street continuing east across Main Street to the western
building line on the north side of Church Street continuing south across Ninth Street to
the southern building line on the east side of Ninth Street continuing west to the eastern
building line of Rock Street and then continuing north across Sixth street to the eastern
building line, and to include sidewalks and alleys immediately adjacent to such
boundaries."
SECTION 3. Chapter 12.24, Section 12.24.120 of the Code of Ordinances of the City
of Georgetown, Texas is hereby added to read as follows:
"No person shall possess or use a glass bottle or glass container in the downtown
square and adjacent area during a parade, festival or special event. This provision shall
not include glass or ceramic craft items displayed for sale as a part of a festival or special
event."
SECTION 4. Any person violating any provision of this Ordinance shall be deemed
guilty of a misdemeanor, and upon conviction thereof, shall be punished up to the maximum fine
allowed by law.
SECTION 5. All ordinances and resolutions, or parts of ordinances and resolutions, in
conflict with this Ordinance are hereby repealed, and are no longer of any force and effect.

SECTION 6. If any provision of this ordinance or application thereof to any person or
circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are hereby declared to be severable.
SECTION 7. The Mayor is hereby authorized to sign this ordinance and the City
Secretary to attest. This ordinance shall become effective and be in full force and effect in (10)
ten days on and after publication in accordance with the provisions of the Charter of the City of
Georgetown.
