WHEREAS, the City Charter of the City of Georgetown was amended by vote of the people in April 1986 such that comprehensive planning was established as a continuous and ongoing governmental function; and WHEREAS, said City Charter now states that the comprehensive plan shall include but not be limited to 13 elements which are coordinated and internally consistent, including "a recreation and open space element"; and WHEREAS, City Council Resolution No. 900561 created the Century Plan Parks Plan Working Group and directed said citizens' committee to develop the Parks and Recreation Functional Plan element of the Century Plan; and WHEREAS, the Parks Plan Working Group did meet during 1991 to develop the Parks and Recreation Functional Plan element of the Century Plan; and WHEREAS, the Parks Plan Working Group held a public hearing on the Parks and Recreation Functional Plan on January 9, 1992, to present the Plan to the public and take comments from the community; and WHEREAS, the Georgetown City Council did conduct a public hearing on the Parks and Recreation Functional Plan on January 28, 1992, to take public comments on the Plan; NOW, # ORDAINED BY THE CITY COUNCILOF CITY 1, GEORGETOWN, SECTION 1. The facts and recitations contained in the preamble of this Ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council finds that this Ordinance implements the following policies contained in the Century Plan - Policy Plan: Facilities and Services Policy 1 which states "The City will endeavor to increase the quality of life through Parks Plan Ordinance No. Page 1 of 3 the upgrading of existing facilities and services and the provision of new services to meet the specific needs of the community"; Recreation and Cultural Affairs Policy 1 which states "The City shall encourage all citizens to actively participate in community -wide social, cultural, and recreational activities"; and Recreation and Cultural Affairs Policy 2 which states "The City will assist in providing all its citizens the opportunity to participate in recreational and cultural programs. " It further finds that this action is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, SECTION 2. The attached EXHIBIT A, relating to the Parks and Recreation Functional Plan is hereby adopted by the City Council of the City of Georgetown, Texas, as a legally binding element of the Century Plan. The Parks and Recreation Functional Plan shall be implemented in accordance with the Administrative procedures in Chapter Four of the Policy Plan element of the Century Plan adopted on March 8, 1988, and as amended from time to time. All future activities relating to the parks and recreation program of the City of Georgetown shall be in conformity with the adopted Parks and Recreation Functional Plan. SECTION 3. Chapter 1.12 of the Georgetown Code of Ordinances is hereby amended by adding Section 1.12.040 to read as follows: LM040 Functional parr and recreation plan adopted. In accordance with Chapter 1.08, Subsection 2 of the Georgetown City Charter, the City Council of the City of Georgetown has adopted that certain document entitled the "Parks and Recreation Functional Plan element of the Century Plan" for the purpose of directing the City Council, staff, and/or commissions in rendering actions and resolutions relating to the utilization of all of the available resources within the City and its Planning Area for the purpose of developing and conducting the parks and recreation programs of the City of Georgetown. This document may be amended from time to time. SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 5. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
