HomeMy WebLinkAboutORD 94-32 - Tx Utility Electric CompanyWHEREAS, on June 6, 1994, Texas Utilities Electric Company filed with the City of Georgetown its Petition and Statement of Intent proposing four tariff schedules for implementation within this municipality on July 11, 1994; and WHEREAS, the City of Georgetown suspended the proposed effective date of said proposed tariff schedules as permitted by Section 43(d) of the Public Utility Regulatory Act; and WHEREAS, the City Council of the City of Georgetown finds that good public policy dictates that competition within the electrical industry is best served at the generation and transmission level; and WHEREAS, the City of Georgetown, having considered the proposed tariff schedules and the data supporting same finds that one of the four proposed new tariff schedules supports good public policy and therefore should be approved and the remainder disapproved; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policies of the Century Plan - Policy Plan Element: Utilities/Energy Policy 2: "The City will establish Utility policies which take into consideration the needs of all citizens of the community and take necessary precautions to prevent harmful ecological impact on the environment." Utilities/Energy Policy 5: "The City will provide water, wastewater, electricity, and solid waste collection services which meet the immediate and future needs of all citizens and which encourages and provides for economic development." TU Rate Ordinance No. Page 1 of 3 Pages Utilities/Energy Policy 6: "The city will monitor the development of franchised utilities that provide adequate service for all citizens." and further finds that the adoption of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. On June 6, 1994, Texas Utilities Electric Company filed with the City of Georgetown a Petition and Statement of Intent proposing to implement four new tariff schedules: Rider ED - Economic Development Service; Rate GC - General Service Competitive Pricing; Rate WPC - Wholesale Power Competitive Pricing; and Rider ET - Environmental Technology Service. The following of said proposed tariffs are each hereby denied for implementation by Texas Utilities Electric Company within the corporate limits of the City of Georgetown: a) Rider ED - Economic Development Service, b) Rate GC - General Service Competitive Pricing, and c) Rider ET - Environmental Technology Service. Only the Rate WPC - Wholesale Power Competitive Pricing tariff is approved for implementation by Texas Utilities Electric Company within the corporate limits of the City of Georgetown, until such time as said tariff schedules may be changed, modified, amended, or withdrawn with the approval of the City of Georgetown. SECTION 3. The aforesaid tariff schedules herein approved shall be effective from and after the final passage of this ordinance. SECTION 4. The filing of said tariff schedules herein approved shall constitute notice to the consumers of electricity, within this municipality, of the availability and application of such tariff schedules. SECTION 5. Nothing contained in this ordinance shall be construed now or hereafter as limiting or modifying in any manner, the right and power of the City of Georgetown under the law to regulate the rates, operations, and services of Texas Utilities Electric Company. SECTION 6. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. TU Rate Ordinance No. Page 2 of 3 Pages SECTION 7 If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable.
