TEXAS AMENDING CHAPTER 4.08, "AUTHORITY OF THE CITY MANAGER TO
CONTRACT", SECTION 4.08.010 "AUTHORIZED" OF THE CODE OF
ORDINANCES OF THE CITY OF GEORGETOWN TEXAS BY AUTHORIZING THE
CITY MANAGER TO CONTRACT FOR EXPENDITURES LESS THAN
$15,000.00, AND ENCOURAGE THE UTILIZATION OF LOCAL BUSINESS
AND SERVICE PROVIDERS WHEN CONSISTENT WITH STATE LAGS' AND A
PRUDENT EXPENDITURE OF PUBLIC FUNDS; REPEALING CONFLICTING
ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE;
AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Georgetown, Texas deems it
necessary and proper to amend Chapter 4.08 "Authority of the City
Manager to Contract". Section 4 . 08 . 010 "Authorized". of the Code of
Ordinances of the City of Georgetown,Texas; and
WHEREAS, the City Charter of the City of Georgetown, Texas,
provides the City Manager with the authority to contract for
expenditures without further approval of the City Council for all
budgeted items not exceeding $15,000.00, when an ordinance is
adopted and the Council desires to adopt the same;
rvgHEREAS, the City Council of the City of Georgetown finds it
appropriate to encourage the utilization of local business and
service providers when consistent with state law and a prudent
expenditure of public funds; and
WHEREAS, the City Council of the City of Georgetown believes that
by encouraging local purchasing all citizens of Georgetown benefit;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS that:
SECTION 1. The facts and recitations contained in the preamble of
this ordinance are hereby found and declared to be true and
correct, and are incorporated herein and expressly made a part
hereof, as if copied verbatim. The City Council hereby finds that
this ordinance implements Economic Development Policy 3 of the
Century Plan- Policy Plan Element, which. states:"The City will
encourage all citizens to actively participate in local trade and
commerce" and Finance Policy 1 of the Century Plan -Policy Plan
Element, which states:"The City will conduct all municipal
operations in an efficient business -like manner", and further finds
that the enactment of this ordinance is not inconsistent or in
conflict with any other Century Plan Policies, as required by
section 2.03 of the Administrative Chapter of the Policy Plan.
SECTION 2. Chapter 4.08 "Authority of the City Manager to Contract"
of the Code of Ordinances of the City of Georgetown, Texas is
hereby amended to read as follows°
Sec. 4,08.010 Authorized
The City
Manager
is authorized to contract for expenditures for
budgeted
items in
amounts not
to exceed fifteen thousand dollars
($151000400).
All
contracts
for expenditures involving fifteen
thousand
dollars ($15,000.00)
or more must be expressly approved in
advance
by the Council,
It is the desire of the City Council to encourage local business
development, and itsThen allowable by state law to give preference to
local business, in compliance with City Charter. In the event that
a local vendor is within five (5) percent of the purchase price of
an out of town vendor, preference will be given to the local
vendor. For purchases of $15,000.00 or more, the City will award
bids to the lowest responsible bidder, in compliance with state law
and the prudent expenditure of public funds,
SECTION 3, All ordinances and resolutions, or parts of ordinances
and resolutions, in conflict with this Ordinance are hereby
repealed, and are no longer of any force and effect.
SECTION
4.
If any provision of this ordinance or application
thereof
to
any person
or circumstance shall be held invalid, such
invalidity
shall
not affect the other provisions, or application
thereof,
of
this
ordinance which can be given effect without the
invalid
provision
or application and to this end the provisions of
this ordinance are hereby declared to be severable,
SECTION 5. The .mayor is hereby authorized
and the City Secretary to attest. This
effective and be in full force and effect
after publication in accordance with the
Charter of the City of Georgetown.
