WHEREAS, on November 13, 1990, the City Council adopted Ordinance No. 900555
relating to the regulation of the smoking of tobacco products in public places;
WHEREAS, this Ordinance became effective on January 14, 1991;
WHEREAS, the Georgetown Independent School District ("GISD") has requested that this
Ordinance be amended to prohibit smoking on public school property with the exception of
posted areas, in order that GISD officials could enforce their no smoking policy on public school
property, and encourage students to make a statement that speaks to the problem of tobacco abuse
on a "smoke -free" campus and school district;
WHEREAS, the City Council has determined that this amendment to the Ordinance
relating to the regulation of the smoking of tobacco products on GISD property is in the best
interest of the students of Georgetown Independent School District, and is necessary in order to
protect the health and welfare of the students;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
GEORGETOWN,
SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby
found and declared to be true and correct, and are incorporated by reference herein and expressly
made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance
implements the following Policies of the Century Plan - Policy Plan Element:
1. Governmental Affairs Policy 1, which states: "The City will actively pursue
increased cooperation with all other entities which provides services in the
community";
2. Facilities and
Services Policy
1, which states: "The
City will
endeavor to increase
the quality of
life through the
upgrading of existing
facilities
and services and the
provision of new services to meet the specific needs of the community"; and
3. Education Policy 1, End A, which states: "The City will cooperate with the
Georgetown Independent School District (GISD) in providing a physical
environment conducive to education in a cost-efficient manner"
and further finds that the enactment of this ordinance is not inconsistent or in conflict with any
other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the
Policy Plan,
SECTION 2. Ordinances No. 900558 and 91-4 shall hereby be codified to be included in
Chapter 8.32 of the City of Georgetown Code of Ordinances. Any reference to Chapter 8.32 of
the City of Georgetown Code of Ordinances shall apply to all amendments, corrections and
additions heretofore, now or hereinafter made.
SECTION 3. Section 8.32.020 of the Code of Ordinances of the City of Georgetown, Texas, is
hereby amended by adding Subparagraph (15) which shall read as follows:
"(15) All property owned or leased by the Georgetown Independent School District for
school purposes, including but not limited to, school grounds, school buildings, and related
facilities."
Section 8.32.030 of the Code of Ordinances of the City of Georgetown, Texas, is hereby
amended by adding Subparagraph J which shall read as follows:
U. Designated smoking areas established by the Georgetown Independent School
District."
SECTION 4. Nothing in this ordinance shall be construed to permit smoking where it is
otherwise prohibited by law or regulation; as prohibiting any employer or person in control of
premises from prohibiting smoking to a greater extent than is prohibited by this ordinance; or,
as requiring structural changes or additions in buildings.
SECTION 5. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict
with this Ordinance are hereby repealed, and are no longer of any force and effect.
SECTION b. If any provision of this ordinance or application thereof to any person or
circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or
application thereof, of this ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are hereby declared to be severable.
SECTION 7. The Mayor is hereby authorized to sign this ordinance and the City Secretary to
attest. This ordinance shall become effective and be in full force and effect in (10) ten days on
and after publication in accordance with the provisions of the Charter of the City of Georgetown.
