WHEREAS, the City Charter of the City of Georgetown was amended by vote of the people in April 1986 such that comprehensive planning was established as a continuous and ongoing governmental function; and WHEREAS, said City Charter now states that the comprehensive plan shall include but not be limited to 13 elements which are coordinated and internally consistent, including "a public buildings and related facilities element"; and WHEREAS, City Council Resolution No. 960123-VV, on January 23, 1996, created the Century Plan Facilities and Services Plan Working Group and directed said citizens' committee to develop the Facilities and Services Functional Plan element of the Century Plan; and WHEREAS, the Facilities and Services Plan Working Group did meet during 1996 to develop the Facilities and Services Functional Plan element of the Century Plan; and WHEREAS, the Facilities and Services Plan Working Group held a public hearing on the Facilities and Services Functional Plan on May 23, 1996, to present the Plan to the public and take comments from the community; and WHEREAS, the Georgetown City Council did conduct a public hearing on the Facilities and Services Functional Plan on August 27, 1996, to take public comments on the Plan; THEREFORE, BE ITORDAINED BY THE CITY COUNCIL OF GEORGETOWN, SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Policy End 4.0 of the Century Plan - Policy Plan Element, which states: "The City provides for the safety of its citizens and supports the responsive delivery of coordinated services by the City and other public agencies", and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. Facilities and Services Plan Ordinance 9 SECTION 2. The Facilities and Services Functional Plan is hereby adopted by the City Council of the City of Georgetown, Texas, as a legally binding element of the Century Plan. The Facilities and Services Functional Plan shall be implemented in accordance with the Administrative procedures in Chapter Four of the Policy Plan element of the Century Plan adopted on March 8, 1988, and as amended from time to time. The Plan document, which was the subject of an August 27, 1996 public hearing by the City Council, is incorporated by reference herein. SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with provisions of the City Charter of the City of Georgetown.
