HomeMy WebLinkAboutORD 96-33 - Extending Sign OrdoRDINANCE NO AN ORDINANCE OF THE CITY COUNCILOF i• i TEXAS, EXTENDING THE EXPIRATIONDATE OF THE GEORGETOWN SIGN ORDINANCE, ALSO KNOWN AS CHAPTER 12.10 OF THE GEORGETOWN MUNICIPAL CODE; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; ANi' ESTABLISHINGDATE. WHEREAS,•216.901 of • , Government ••- authorizes home rule municipalities to license, regulate, control, or prohibit the erection of signs or billboards; and WHEREAS, Section 54.004 of the Local Government Code authorizes home rule municipalities to enforce ordinances necessary to protect health, life, and property and to preserve the good government, order, and security of the municipality and its inhabitants; and WHEREAS, on February 9, 1993, by the approval of Ordinance 93-5, the City did adopt the "Sign Ordinance of the City of Georgetown", codified as Chapter 12.10 of the Georgetown Municipal Code, hereinafter referred to as "Sign Ordinance"; and WHEREAS, Ordinance 93-5, Section 4, provides for the sunset of the Sign Ordinance in three (3) years, unless action is taken to extend its application and enforcement; and WHEREAS, on February 13, 1996, by approval of Ordinance 96-04, the City did extend the Georgetown Sign Ordinance to a new expiration date of August 24, 1996; and WHEREAS, the Georgetown City Council has directed the staff to suspend work on revisions to the Georgetown Sign Ordinance until the Urban Design Functional Plan Element of the Century Plan is completed; and WHEREAS, due to the level of development activity it is important to extend the effective date of the current Sign Ordinance in order to ensure its continuing effectiveness. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITE' OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements 1. Growth and Physical Development Policy 1 which states "The City will ensure that future land use patterns provide economic, cultural, and social activities to all residents, businesses and organizations"; and 2. Growth and Physical Development Policy 2 which states "The City's regulatory action will efficiently and effectively implement the policy statements and provide the Sign Ordinance Extension Ordinance No.� Page 1 of 2 opportunity to seek change with reasonable effort and expense"; and 3. Development Plan Policy S, End B, Ongoing Means 1, which states "The City shall prepare development regulations that protect neighborhoods from incompatible land uses and assure that residential neighborhoods are accessible to community facilities and services"; and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, SECTION 2. The application and enforcement of the Sign Ordinance is hereby extended to December 31, 1999, such that, unless subsequent action extends the application and enforcement of the Sign Ordinance, it shall expire on that date. SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective immediately upon approval of the Second Reading, but it will not be enforceable with criminal penalties until (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown, PASSED AND APPROVED on First Reading on the 23rd day of July, 1996.
