HomeMy WebLinkAboutORD 97-19 - Single Member District PlanVV ORDINANCE NO. `/__ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, AMENDING THE CITY'S SINGLE -MEMBER DISTRICT PLAN TO INCLUDE THE FOLLOWING AREAS: 2.821 ACRE TRACT KNOWN AS NORTHWEST BOULEVARD RIGHT-OF-WAY; 1,228 ACRE TRACT KNOWN AS BERRY CREEK SUBDIVISION, SECTIONS 1 THROUGH 11, GOLF COURSE AND FUTURE DEVELOPMENT AREAS; AND 128 ACRE TRACT KNOWN AS SERENADA EAST; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, in Ordinance 91-30, the City Council adopted the City's current single - member district plan and amended that ordinance with Ordinance 95-11 and Ordinance 96-09. WHEREAS, such plan was later approved by the United States Department of Justice to be used for selection of elected officials for the Mayoral and City Councilmember elections within the City of Georgetown; WHEREAS, the City has annexed additional property and is currently in the process of annexing certain property adjacent to the City limits; WHEREAS, these annexations and proposed annexation of property adjacent to the City limits of the City of Georgetown require that the City amend its single -member district plan to incorporate these newly annexed properties within the City's single -member district plan for election purposes; WHEREAS, the City election will occur immediately after the completion of all of the annexations; WHEREAS, since the approval of the U.S. Department of Justice is required to amend the City's single -member district plan, and such approval must be submitted well in advance of the City's election; WHEREAS, according to the most recent decennial census in 1990, these recent annexations contained significant population in 1990, necessitating that some of the existing single -member district boundaries be redrawn; WHEREAS, each of the annexed tracts is immediately adjacent to an existing single -member district boundary line; Single -Member District Revision 1997 Ordinance No.. r 147 Page 1 of 3 WHEREAS, the City Council hereby determines that the addition of these annexed tracts to the adjacent single -member districts and respective redrawing of district boundaries is in the best interest of the City, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Governmental Affairs Policy 2 of the Century Plan - Policy Plan Element, which states: "The City will encourage all citizens to actively participate in governmental functions", and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The following boundary revisions to the City's single -member district plan are hereby adopted: A. The census blocks denoted on Exhibit A shall be moved from District 5 to District 4. B. The census blocks denoted on Exhibit B shall be added to District 5. C. The census blocks denoted on Exhibit C shall be moved from District 5 to District 6. A portion of Census Block 310A, as denoted on Exhibit C, shall be moved from District 2 to District 6. D. The census blocks denoted on Exhibit D shall be moved from District 6 to District 7. SECTION 3. The map attached as Exhibit E is hereby adopted as the official single -member district boundary map, reflecting the changes in census blocks specified in Section 2. SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 5. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest.
