HomeMy WebLinkAboutORD 97-18 - ANX Serenada EastORDINANCE NO. qj� I _ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF GEORGETOWN, TEXAS, AND THE ANNEXATION OF CERTAIN TERRITORY DESCRIBED IN EXHIBIT A OF THIS ORDINANCE, CONSISTING OF: APPROXIMATELY 128 ACRES IN THE DAVID WRIGHT SURVEY LOCALLY KNOWN AS SERENADA EAST UNITS 1, 4, 5, PORTIONS OF UNITS 2 AND 3 AND SURROUNDING AREA, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMIT OF THE CITY OF GEORGETOWN, TEXAS AND NOT BEING A PART OF ANY INCORPORATED AREA; PROVIDING FOR SERVICE PLANS; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Georgetown, Texas, may under the Charter of said City, Section 1.06, annex areas as allowed by State law; and WHEREAS, notices of two (2) public hearings were published according to law in a newspaper having general circulation in the City of Georgetown, Texas, and in the herein described territory to be annexed not more than twenty (20) days nor less than ten (10) days prior to those hearings; and WHEREAS, two public hearings by the City of Georgetown, Texas, where all interested persons were provided with an opportunity to be heard on the proposed annexation of certain tracts of land located in Williamson County, Texas, including the following tracts described in Exhibit A of this ordinance: APPROXIMATELY 128 ACRES IN THE DAVID WRIGHT SURVEY, LOCALLY KNOWN AS SERENADA EAST SUBDIVISION UNITS 1, 47 5 AND PORTIONS OF UNITS 2 AND 3 AND SURROUNDING AREA; were held, the first being on the 11th day of February, 1997, and the second being on the 18th day of February, 1997; and WHEREAS, at such public hearings, a proposed service plan was presented to and discussed by the Council and all interested persons; and WHEREAS, such public hearings were held not more than forty (40) nor fewer than twenty (20) days prior to the institution of these proceedings; and WHEREAS, the total corporate area of the City of Georgetown, Texas, on the 1st day of January, 1997, was approximately 20 square miles; and Annexation of approximately 128 acres containing Serenada East, Units 1, 4, and 5 and portions of 2 and 3 Ordinance No.fr=7ZZ_ Page 1 of 3 WHEREAS, the population of the City of Georgetown, Texas includes approximately 19,750 inhabitants; and WHEREAS, all of the herein -described property lies within the extraterritorial jurisdiction of the City of Georgetown, Texas; and WHEREAS, the herein -described property lies adjacent and contiguous to the City of Georgetown, Texas; and WHEREAS, all notices and other prerequisites of state law and the City Charter have been complied with; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following Policy Ends of the Century Plan - Policy Plan Element: 1. Environmental and Resource Conservation End 3.0, which states: "The physical qualities that make Georgetown attractive are protected"; and 2. Growth and Physical Development End 7.2, which states: "Annexation procedures and standards benefit the community" and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The City Council hereby finds this annexation, which causes an area not within the City limits to be entirely surrounded by the City limits, is in the public interest. SECTION 3. The City Council of the City of Georgetown hereby annexes: APPROXIMATELY 128 ACRES IN THE DAVID WRIGHT SURVEY, LOCALLY KNOWN AS SERENADA EAST SUBDIVISION UNITS 1, 4, 5 AND PORTIONS OF UNITS 2 AND 3 AND SURROUNDING AREA, as described in Exhibit A of this ordinance, which contains the map and property descriptions for the tracts. Exhibit B contains the service plan. SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. - Annexation of approximately 128 acres containing Serenada East, Units 1, 4, and 5 and portions of 2 and 3 Ordinance No. Page 2 of 3 SECTION 5. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown. PA e6: 6 EXHIBIT A ANNEXATION OF SERENADA EAST SUBDIVISION AND SURROUNDING AREA A 128 ACRE TRACT, MORE OR LESS, IN THE DAVID WRIGHT SURVEY Being all that certain 128 acre annexation tract, more or less, in the David Wright Survey in the Williamson County, Texas land records and including the following subdivisions, tracts, or parcels: 1. Subdivision; 0.50 acres, more or less 10. 17.05 acre portion, more or less, of a 40.61 acre tract conveyed to Raymond Joseph, et al, in Volume 2392, Page 587 EXHIBIT B CITY OF GEORGETOWN, TEXAS ANNEXATION SERVICE PLAN SERENADA EAST - UNITS 1, 41 5, PORTIONS OF UNITS 2 AND 3, AND SURROUNDING AREA Introduction This service plan has been prepared in accordance with Texas Local Government Code, Chapter 43 - Municipal Annexation. This requires that the service plan provide for the extension of full municipal services to the area to be annexed by any of the methods by which it extends services to any other area of the municipality. Police Protection Police services will be provided upon the effective date of the annexation. These services include regular and routine patrols, investigations and other services, including crime prevention, victim services, and youth services. Officers patrol the City within specified districts, or "beats", that are accessible enough in size and by roadways to enable officers to effectively respond to calls for service. The beats are designed with several factors in mind, including geographic identification (i.e., street, railroad, water way, highway, property line), total area, population density, geographic boundaries, recorded or anticipated demands for service, street design, ingress and egress, and accessibility distances. The City currently has 3-5 officers on patrol at a given time. A new patrol district for the northwest part of the City is planned. Each district requires six officers to be adequately staffed for all patrol shifts. The City's Annual Operating Plan for the current fiscal year (1996-97) includes three additional officers. An additional three officers will be included in the funding request for the 1997-98 fiscal year. Fire Protection and Code Enforcement Fire protection and prevention services are currently being provided to the area through an agreement with Williamson County. At the present time, there is a different level of response to a fire in the area covered by the County agreement and to a fire within the City limits. Upon the effective date of the annexation, all calls for service will go directly to the City's dispatcher for response by one of the two City fire stations. If the situation requires additional units for assistance, these units can be sent to the site immediately. In addition, through the City's "first responder" program, fire fighters respond to all medical emergency calls within the City limits. Because they typically have a shorter distance to travel, Georgetown fire fighters, who are trained to respond to medical emergencies, are often able to arrive on the scene of an emergency and render aid before the Williamson County Emergency Medical Services (EMS) units can. This heightened level of medical emergency response will be available to newly annexed areas. Serenada East Units 1, 4, 5 and portions of 2 and 3 and surrounding area Annexation Service Plan, Page 1 of 6 J EXHIBIT B The fire insurance rates paid by residents and non-residents of the City of Georgetown are largely determined by how well the City's fire services meet standards established by the State Board of Insurance. The adequacy of the water supply and distribution facilities for fire fighting capabilities, including water storage capacity, the water distribution system, and the spacing of fire hydrants are also important in determining the rates. Water lines in residential areas must be a minimum of six inches and in commercial areas at least eight inches, with adequate water pressure. While the developed portion of the proposed annexation area is served adequately by water supply and distribution systems, the differences in the level of response within the City and in the County contract area may provide the residents of the newly annexed area with lower fire insurance rates. The Fire Services Division also manages the code enforcement activities of the City, including high weeds and other safety codes. Newly annexed areas will be subject to these health and safety regulations, such as prohibitions against open fires. Solid Waste Collection The City contracts for sanitation services on behalf of the residents of the City. The contractor, in turn, has exclusive rights to serve all residential, commercial, and construction properties within the City limits. Newly annexed areas will receive once a week garbage pick-up with a cart furnished by the contractor and once a week recycling pick-up with an 18 gallon recycling bin furnished by the contractor. Each month a resident may place up to five cubic yards of bulky waste at the curb for pick-up at no charge. Bulky waste in excess of five yards each month will be billed on a per cubic yard basis. The City's collection station will continue to be available to newly annexed residents. The public collection station presently charges fees for all waste coming into the collection station, except for brush for chipping, automotive fluids and tires for recycling. Electric Service Electric service is currently provided by the City of Georgetown and will continue to be provided upon annexation. As rates for electric service are currently the same for areas inside and outside of the City limits, there will be no change in the rates as a result of annexation. Water Service The area is currently served by the City's water system. At the present time, water customers outside of the City limits are charged a higher rate than customers inside of the City limits. Upon the effective date of the annexation, water rates will be reduced to the rates charged to customers inside the City. Some residents may have private wells used for yard irrigation. These situations will be allowed to continue, however, no additional wells will be allowed except for ground -source HVAC units, which will require a permit from the Building Department, Serenada East Units 1, 4, 5 and portions of 2 and 3 and surrounding area Annexation Service Plan, Page 2 of 6 EXHIBIT B Water lines will be extended in accordance with City policy. The City has a Utility Expansion and Improvement Policy, which is described in this service plan. Sewer Service A portion of the area is currently served by City of Georgetown sewer service (see area labeled "Sewer Service Available" on attached map). Some properties in this area are already connected to the sewer. The capital improvements necessary for providing sewer service to the remainder of the area (labeled "Future Sewer Service Area" on the attached map) will begin upon annexation and will be substantially completed within 4-112 years after the effective date of annexation. There will be no requirement for connection to the sewer system as long as the septic system on the property functions properly. The total connection cost for single-family residential service is presently $1,425. The City has a payment plan available which allows payments to be made for five years at a six percent interest rate, after a down payment. Property owners in the proposed annexation area will be allowed to connect to the sewer system under the present rate structure for one year from the date of the public sewer line being made available to their property. After this one year period, connections will be made using the fees applicable at the time of connection. In addition to the fees, each residential lot with a septic system must provide a private connection from the house to the sewer line and the septic system must be properly closed. The estimated average cost for this plumbing work is $2,400, ranging from $1,500 to $3,100. The City is supporting a bill in the current legislative session which would allow the cost of these private improvements to be financed through the City. Maintenance of Roads Streets and Drainage Roads, streets and drainage facilities dedicated to the public will be maintained according to City Code and policy upon the effective date of the annexation. Street L12htin( Street lights will be provided by the City according to the City's standards, upon petition of a majority of the property owners in the immediate vicinity of the location of the light. Electricity cost and ongoing maintenance for existing street lights which meet the City's standards will become the responsibility of the City. City standards allow for street lights at intersections and at the mid -point of blocks which are more than 600 feet in length. The cost of electricity of existing street lights which meet this standard will become the City's responsibility upon annexation. Street lighting installed as a result of annexation will be the same style and type of construction as the existing lighting. The residents of these already have access to the City's parks, the operation and maintenance of which are funded partially through ad valorem taxes. The ad valorem tax revenue from the annexed areas will provide additional support for parks and recreation. The Century Plan - Parks and Recreation Plan provides standards for the location of a variety of different types of parks in the community and contains the policy direction for the City's parks and recreation function. Once annexed into the City, residents will be eligible for reduced rates and priority registration for City Parks and Recreation facilities and programs. Planning, Zoning and Inspection Services Annexation will allow the application of the City's Zoning Ordinance, which controls the location of land uses, to the newly annexed area. Zoning can only be applied within the City limits. Areas that are currently platted, with specific land uses designated, will be proposed for zoning appropriate to those land uses. These rezonings will be conducted according to the City's established process. Unplatted property, or platted properties without a specific land use designation, will be zoned A -Agricultural upon annexation. The owners of these properties may request a rezoning through the City's established process, at any time. The enforcement of zoning, building, traffic safety, code enforcement, and other health and safety regulations will also be extended to newly annexed areas. Building codes will also apply to the newly annexed area. Although building codes are not applied in the City's extra -territorial jurisdiction (ETJ), the codes which regulate specific trades (plumbing, electrical, mechanical) are currently applied when the City's water, wastewater, or electric services are provided. Extension of the City's development controls throughout the watersheds which impact Georgetown can also have a positive impact on water quality in Georgetown. Because Georgetown's water sources include both the Edwards Aquifer and Lake Georgetown, the City has an important interest in protecting those resources. Furthermore, a significant amount of Georgetown's current ETJ is part of the Edwards Aquifer recharge zone and is sensitive to potential contamination. Strategic extension of the City's boundaries can extend the ETJ to protect both the ultimate service area of the City and the areas which have a high impact on the City's natural resources. Library Services A Georgetown Public Library card is currently available free of charge to City residents and property owners. Non-residents can purchase an annual library card for a fee of $15 for individuals and $25 for families. Serenada East Units 1, 4, 5 and portions of 2. and 3 and surrounding. area Annexation Service Plan, Page 4 of 6 EXHIBIT B Animal Services Annexed areas would come under the jurisdiction of the City's animal control regulations, including the "leash law" and licensing. Unincorporated areas of Williamson County are currently under the jurisdiction of the County's animal control officers. Since the City's officers have a smaller geographic area to cover and respond from a closer location, the provision of services will be enhanced. While the City's animal control ordinances differ slightly from those adopted by the County, the primary difference will be that City residents receive their animal licenses from the City and any impounded animals are kept in the City facility in Georgetown. Some prospective annexation areas may want to take advantage of the City's zoning districts that allow the keeping of livestock. All newly annexed areas are designated A - Agricultural district under the Zoning Ordinance, unless a separate rezoning action is initiated. The A district allows the keeping of livestock for personal and commercial purposes. The RE, Residential Estate district also allows the keeping of livestock, but under strict conditions relating to the size of the lot, the number and type of animals, and the manner in which they will be confined. Other Services Other services provided by the City, such as animal control, court, and general administration, will be made available upon the effective date of the annexation, in accordance with the City Code and policies. Extension of Ret)resentation One of the major reasons why residential areas are annexed is to provide citizens with political representation. Other than the fact that the proposed area is outside the City limits line, it is generally indistinguishable from the rest of the City, yet residents presently have no real voice in the government of the City of Georgetown. Annexation allows new residents to vote in City elections, to seek City elected offices, and to serve on many boards and commissions that are limited to City residents. These rights give residents the power to influence the future of Georgetown. Annexation of populated areas, however, changes the representation of the existing population. People who live adjacent to the City and support the City through utility bills, sales taxes, and participation in various organizations would be granted direct representation in the City's affairs. It is anticipated that the area proposed for annexation will be placed in City Council District 5, currently represented by Dick Vincent, whose current term expires in May 1997. If the annexation is effective before the commencement of early voting on April 14, 1997, newly annexed residents would be eligible to vote in the City Council election to be held on May 3, 1997.
