HomeMy WebLinkAboutORD 97-10 - Water Meter Process*RDINANCE NOS AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, ESTABLISHING THE PROCESS FOR DISTRIBUTION OF WATER METERS; PERMITTING THE ASSESSMENT OF PENALTIES AND FINES; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, it is the intention of the City of Georgetown to redesign its processes for the review and approval of development applications: WHEREAS, the City Council has determined that revising the process for distribution of water meters is in the best interest of the citizens and the businesses in the City of Georgetown; WHEREAS, Chapter 1.08.010 of the Georgetown Municipal Code establishes the general penalties permitted for violations of any City code or ordinance; and WHEREAS, Chapter 13.04.150 of the Georgetown Municipal Code establishes rates for the sale of water meter taps. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements Century Plan Policy 7. 1, which states The City's regulations implement the Policy Ends and provide the opportunity to seek change with reasonable effort and expense." and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. The City staff is hereby authorized to implement a process whereby builders receive a water meter upon the payment of a tap fee for installation at any residential address requiring a meter of one (1) inch or less in size. This process shall. use all possible means to avoid error on the part of builders/plumbers when installing water meters at the assigned address. Water Meter Process Ordinance No. _ Page 1 of 2 SECTION 3. Only licensed plumbers will be permitted to install water meters. SECTION 4. Builders and/or plumbers responsible for construction at which a water meter has been installed at the incorrect address shall be assessed a penalty to include the cessation of distribution of meters until the error is corrected and a monetary fine as established by Chapter 1.08.010 of the Georgetown Municipal Code, SECTION 5. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 6. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application .thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 7. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
