AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, REVISING THE TRAFFIC CODE OF THE CITY
OF GEORGETOWN, TEXAS BY ADDING SECTION 10.12.035 TO THE
CODE OF ORDINANCES RELATING TO SPEED LIMITS ON
INTERSTATE HIGHWAY 35 FRONTAGE ROADS TO SET A SPEED
LIMIT FOR I-35 EAST FRONTAGE ROAD; REPEALING CONFLICTING
ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY
CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the Texas Department of Transportation has issued a statement of
substantial completion regarding construction of the 1-35 East Frontage Road; and
WHEREAS, the
City
has accepted construction of the
1-35
East Frontage Road by
passage of Resolution
No.
970128 -HH dated January 28, 1997;
and
WHEREAS, the City desires to set a speed limit on the 1-35 East Frontage Road;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this ordinance
are hereby found and declared to be true and correct, and are incorporated by reference
herein and expressly made a part hereof, as if copied verbatim. The City Council hereby
finds that this ordinance implements Transportation Policy 1 of the Century Plan - Policy
Plan Element, which states: "The City will encourage a transportation system that
provides for the safe and efficient movement of traffic, promotes the economic interests
of the community, and adequately serves the personal needs of individuals", and further
finds that the enactment of this ordinance is not inconsistent or in conflict with any other
Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the
Policy Plan.
SECTION 2. Section 10.12.035 of the Code of Ordinances of the City of
Georgetown, Texas is hereby added to read as follows:
10.12.035 Interstate Highway 35 East Frontage Road
It is determined upon the basis of an engineering and traffic investigation
that the prima facie maximum speed limit on those portions of the east frontage
road of Interstate Highway 35 routed in the City is as stated in this section, which
prima facie maximum speed limit is effective at all times, and signs will be erected
giving notice of the prima facie maximum speed limit so declared:
A. 1-35 East Frontage Road from State Highway 29 to FM 2338:
It is determined that the maximum speed limit on the northbound 1-35 East
Frontage Road from State Highway 29 to FM 2338 shall be set at 55 miles
per hour.

SECTION 3. All ordinances and resolutions, or parts of ordinances and
resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any
force and effect.
SECTION 4. If any provision of this ordinance or application of it to any person
or circumstance, is held to be invalid, the remainder of the ordinance which can be given
effect without the invalid provision or application shall applied as valid and is hereby
declared to be severable from the invalid portion.
SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City
Secretary to attest. This ordinance shall become effective and be in full force and effect
in (10) ten days on and after publication in accordance with the provisions of the Charter
of the City of Georgetown.
