HomeMy WebLinkAboutORD 98-27 - IH-35 Frontage Assessment*RDIINANCE • /; WHEREAS, on November 28, 1995, the City Council expressed its intent to allow reapportionment of the assessments which were levied against property owners along the North/East IH -35 Frontage Road for a portion of the costs of construction of the frontage road, to allow for resubdivision of property and increased marketabiltiy of lots; and WHEREAS, the property described in the original assessment as 52.72 acres and more particularly described by metes and bounds on Exhibit "B" to Ordinance No. 9342 (the "Assessed Property"); and WHEREAS, First Gibralter Bank was the owner of the Assessed Property at the time of the original assessment; and WHEREAS, the current owner of the Assessed Property is Georgetown San Gabriel Properties, Ltd.; and WHEREAS, on January 6, 1998, the City Council approved the Public Review Final Plat for subdivision of 32.052 acres of the Assessed Property to be known as San Gabriel Village Section One, as shown on the attached Exhibit A to this ordinance ("Section One"); and WHEREAS, since the Record Final Plat for Section One has not yet been recorded in the Plat Records of Williamson County, Texas, the reapportionment of the assessment on the Assessed Property for Section One shall be accomplished by reference.to field notes attached as hereto Exhibits B-1 through B-2, which are in the same lot configurations as shown on Exhibit A; and WHEREAS, on May 13, 1997, the City Council approved the Preliminary Plat for subdivision of 26.716 acres of the Assessed Property to be known as San Gabriel Village Section Two, as shown on the attached Exhibit C to this ordinance ("Section Two"); and since the Record Final Plats for• • Phase 1 , Lots 1 and ?.nd Phase 2, Lots 3 and 5, have not yet been recorded in the Plat Records of Williamson County, Texas, the reapportionment of the assessment on the Assessed Property for • • • '0• G. -t*,E Pageof Section Two shall be accomplished by reference to field notes attached hereto as Exhibillm D-1 through D-4; and I WHEREAS, the City Council approved the dedication of 9.098 acres of parkland a the dedication of 3.055 acres for public right-of�way; and I WHEREAS, two remnantparcels io g of.022 .. •.215 acres, were platted surrounded by right-of-way to be utilized for landscape purposes by the owners of adjacent !("landscape parcels"); and WHEREAS, the Owner has requested that the full assessment be reapportioned R • rata basis according • the amount of acreage of each of the remaining subdividePA lots, excluding the amount of acreage dedicated for use as parkland, public right -of -w ?.n•. landscape r- and WHEREAS, the City Council has determined that the reapportionment of the assessment is in the best interest of the City, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITJ *F GEORGETOWN, SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policies of the Century Plan - Development Plan Element: 1. Transportation Policy 15, which states: "The City will encourage a transportation system that provides for the safe and efficient movement of traffic, promotes the economic interests of the community, and adequately serves the personal needs of individuals;" 2 Economic Development Policy 1 which states: "The City will encourage a diversified growth and promote business opportunities to create jobs, broaden the tax base and minimize the impact of economic fluctuations," 3. Finance Policy 1 which states: "The City will conduct all Municipal operations in an efficient business -like manner;" and further finds that the adoption of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan.
