desires to establish the Georgetown Builders' Program in order to enable builders who
have met all requirements to qualify as members of the Program to complete the permit
process more expeditiously; and
WHEREAS, the City Council has determined that creation of the Georgetown
Builders' Program will be of benefit to all parties involved in the building permitting process;
and
WHEREAS, the caption of this Ordinance was printed in the Williamson County Sun
on January 21, 1998 in compliance with the City Charter of the City of Georgetown;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GEORGETOWN, TEXAS, THATO
SECTION 1. The facts and recitations contained in the preamble of this Ordinance
are hereby found and declared to be true and correct, and are incorporated by reference
herein and expressly made a part hereof, as if copied verbatim. The City Council hereby
finds that this Ordinance implements Growth and Physical Development Policy End 7.0 of
the Century Plan - Policy Plan Element, which states: "Georgetown's land uses support
economic, cultural and social activities for all residents, businesses and organizations; and
the City's development process encourages new and infill development" and Housing
Policy End 10.0, which states: "The city cooperates with builders, developers and property
owners to provide safe and adequate housing opportunities for all citizens" and further
finds that the enactment of this Ordinance is not inconsistent or in conflict with any other
Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the
Policy Plan.
SECTION 2. Chapter 15,02 of the Code of Ordinances of the City of Georgetown,
Texas is hereby added to read as follows:
15.02 GEORGETOWN BUILDERS' PROGRAM
The Georgetown Builders' Program is created to enable development process
applicants who have consistently met the City's requirements to receive the benefits of
participating in an expedited building and permitting process.

Any builder who has completed construction of at least twelve (12) permitted one
or two family structures in the City of Georgetown within the twenty-four (24) months
preceding application for certification may submit written application on a form provided by
the City for admission to the Georgetown Builders' Program. The City agrees to provide
building permits to all Georgetown Builders' Program members within three (3) business
days of submittal, beginning on the day following the day the submittal is made and ending
at five o'clock p.m, on the third business day thereafter, if all submittal requirements as
listed below are met. No inspections except for plumbing inspections will be required of
Georgetown Builders' Program members at the foundation stage when an engineer's
certification is provided and a survey is completed before the foundation is installed. ALL
PLUMBING INSPECTIONS ARE REQUIRED BY STATE LAW. Inspections will not be
required for framing, electrical or mechanical work if the work is certified by a properly
licensed architect or engineer.
A. Processing application:
1. Applications will be reviewed by the City Building Official and Core
Team Building Plan Reviewer, and applicants will be notified within
five (5) business days of submission as to whether their application
for membership has been accepted or denied. An applicant may
appeal a denial of membership to the Building Standards Commission
within ten (10) business days from the date the applicant receives
notice of denial in accordance with the provisions of subsection D.
2. The list of Georgetown Builders' Program members is public
information; however, the list will not be posted and will be available
only upon request.
B. Submittal requirements:
1. A complete plans submittal application.
2. Each submittal requires sealed building plans to show all proposed
construction details prepared by a properly Texas State licensed
architect or Texas State licensed engineer.
3. Each submittal requires sealed foundation plans prepared by a
properly Texas State licensed architect or Texas State licensed
engineer.
4. Impervious and building coverage calculations must be shown on the
plot plan.
5. A notation with certification by a properly Texas State licensed
architect or Texas State licensed engineer on plans that the design

C. Forfeiture of privileges - Penalty:
Forfeiture of privileges as a member of the Georgetown Builders' Program
will occur when any one of the following things occurs:
1. Required sealed plans - If a member fails to provide the required
sealed plans one time within any twelve month period.
2. Approved plot plan and forms survey - The first time construction is
inconsistent with the approved plot plan or forms survey.
3. Required inspection permits - The first time construction proceeds
without required building permits, to include mechanical, electrical and
plumbing.

Encroachments
into
the
required
building
setbacks
- If one
encroachment occurs
within a
twelve
month
period.
5. Check for insufficient funds - The first check for insufficient funds
received within any twelve month period.
6. Premature occupancy of a residence - The first time there exists a
premature occupancy of a residence before final inspections and
completion of the residential documentation checklist, to include
receipt of all architect and engineer certifications.
®. Warnings; Administrative Assistance
It is anticipated that in the implementation of the program, some coordination
between the City staff and the builders will be required to properly implement
the procedures. In this regard, the City officials are directed to give
administrative warnings for each builder in the Georgetown Builders'
Program for the first two infractions involving one or more of following within

(a) sufficiency of the plans requirement which shall otherwise contain the
required seal;
(b) sufficiency of the approved plot plans and forms survey;
(c) encroachments into required building setbacks.
Any infractions under this ordinance after two warnings have been issued
shall result in the forfeiture of privileges unless otherwise provided herein.
A member builder may appeal forfeiture of his privileges within ten (10) days
from the date of the forfeiture to the Building Standards Commission, and
the Building Standards Commission shall consider that appeal and render its
decision to either reinstate the member's privileges or uphold the forfeiture
within sixty (60) days from the date it receives the appeal.
F. Reinstatement of privileges:
When forfeiture of a builder's privileges occurs, that builder's projects which
were previously approved and are already in progress shall continue under
the Georgetown Builders' Program until completion. No further submittals
will be accepted from a builder who has forfeited privileges until the builder
has demonstrated a pattern of consistent compliance with all requirements
of the Georgetown Builders' Program for six (6) months, or if the infraction
involves any one or more of the following, for a pattern of consistent
compliance with all requirements of the Georgetown Builder's Program for
one (1) year before such builder's privileges can be reinstated:
(a) Construction inconsistent with approved plot plan and forms survey under
Sec. 15.02 subsection C (1)5
(b) Encroachments into the required building setbacks under Sec. 15.02,
subsection C (4); or
(c) Check for insufficient funds under Sec. 15.02, subsection C (5).
If, during the first six (6) months after reinstatement of privileges, an
additional infraction of any one of the requirements occurs, the builder may
not reapply for readmission to the program for a period of twelve (12)
months.
The Georgetown Bui•ers' Program is intended to encourage a ••• working
knowledge of City Codes to ensure more efficient processing of applications

SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions,
in conflict with this Ordinance are hereby repealed, and are no longer of any force and
effect.
SECTION 4. If any provision of this Ordinance or application of it to any person or
circumstance, is held to be invalid, the remainder of the Ordinance which can be given
effect without the invalid provision or application shall applied as valid and is hereby
declared to be severable from the invalid portion.
SECTION 5, The Mayor is hereby authorized to sign this Ordinance and the City
Secretary to attest. This Ordinance shall become effective and be in full force and effect
in (10) ten dans on and after publication in accordance with the provisions of the Charter
of the City of Georgetown.
