HomeMy WebLinkAboutORD 99-51 - Assessments Village PIDORDINANCE i ♦' /` AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, ESTABLISHING THE PROCESSES FOR ADMINISTERING THE ASSESSMENTS FOR THE GEORGETOWN VILLAGE IMPROVEMENT DISTRICT NO. l; REPEALING CONFLICTING ORDINANCES AND RESOLUTIONS; INCLUDING A SEVERABILITY CLAUSE; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, pursuant to Chapter 372 of the Local Government Code and City Resolution Number 990223-N, the City Council of the City of Georgetown, Texas, authorized the creation of Georgetown Public Improvement District No. 1; WHEREAS, pursuant to Chapter 372 of the Local Government Code and City Ordinance Number 990427-Y, the City Council of the City of Georgetown, Texas, levied assessments for the cost and maintenance of certain improvements to be provided in the Gerogetown Public Improvement District No. i and fixed liens against property in the District and against the owners thereof, WHEREAS, the cost of maintenance of certain improvements has been included in the 1999/00 Annual Operating Plan as required by Chapter 372 of the Local Government Code; and WHEREAS, the City Council desires to establish procedures for the administration of these assessments including notices, billing, timing, method of foreclosure, penalities and other procedures consistent with those used for the assessment and collection of city property taxes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, TEXAS, THAT: SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policy of the Century Plan - Policy Plan Element: 1. Finance Policy End 5.0, which states: "All municipal operations are conducted in an efficient business -like manner and sufficient financial resources for both current and future needs are provided", - Establishing Administration Process for Georgetown Public Improvement District No. 1 Ordinance No. +�a �.Wf Page I of 3 P:\AGENDA\99\PID-PROC.WPD and further finds that the enactment of this Ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, SECTION 2. The administration of the annual assessment and collection for Georgetown Village Public Improvement District No. 1 will follow the notices, billing, timing, method of foreclosure, penalities and other procedures used by the City of Georgetown to levy, assess and collect its municipal property taxes. It is the intent of the City to conduct this process and the annual review and update of the service and assessment plan concurrent with its annual budget and tax rate adoption and implementation where applicable. SECTION 3. The City of Georgetown will be reimbursed $2,760, to be reviewed annually, for administering the Georgetown Village Public Improvement District No. 1, as established in the Estimated Cost Plan in Resolution 9900223-N. SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 5. If any provision of this Ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are hereby declared to be severable. SECTION 6. The Mayor is hereby authorized to sign this Ordinance and the City Secretary to attest. This Ordinance shall become effective upon adoption of its second and final reading by the City Council of the City of Georgetown, Texas. PASSED AND APPROVED on First Reading on the 14th day of September, 1999. PASSED AND APPROVED on Second Reading on the 28th day of September, 1999.
