D ON t 14TH DAY OF FEBRUARY1988, WITH ADDITIONALD DEDICATION ZONES ! TO ESTABLISH A MINIMUMTHE PROPERTY FOR i IN RURAL SUBDIVISIONS; r CONFLICTINGr AND I'' i tNS; INCLUDING A SEVERABILITY 1INCLUDING A PENALTY FORVIOLATION; AND ESTABLISHING EFFECTIVE DATE. WHEREAS, in accordance with the Constitution and laws of the State of Texas, including particularly the Local Government Code, Chapter 212, Municipal Regulation of Subdivisions and Property Development; and in accordance with the Charter of the City of Georgetown, Texas, hereinafter referred to as "City", the City is authorized to develop regulations for the subdivision and development of land in the territorial jurisdiction of the City, including the corporate limits, extraterritorial jurisdiction and other areas as permitted by law; and WHEREAS, the "Subdivision Regulations of the City of Georgetown", hereinafter referred to as "Regulations", were initially adopted by the City Council of the City of Georgetown on February 14, 1988, and have been periodically revised since that date; and WHEREAS, the City Council reviewed the proposed revisions and recommended that a public hearing be held to consider adding park land dedication zones and to establish a minimum width at the property line for lots on cul-de-sacs in rural subdivisions to the City's development regulations for development in the territorial jurisdiction of the City of Georgetown, including the corporate limits, extraterritorial jurisdiction and other areas as permitted by law; and WHEREAS, the Parks and Recreation Advisory Board reviewed and recommended adoption of the additional park land dedication zones at their meeting on July 15, 1999 and the City Council reviewed the rural cul-de-sac width standard and directed the preparation of these changes at their April 27, 1999 meeting; THEREFORE, :,ITORDAINED THE CITY COUNCILOF t CITY OF GEORGETOWN, SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and Subdivison Regul ti ns R vision - Additional Park Land Dedication zones and Lots on cul-de-sacs in Rural Subdivisions Ordinance No. Page 1 of 3 expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements the following policies of the Century Plan - Policy Plan Element: 1. Governmental Affairs Policy 6.0 which states "A high level of cooperation and involvement exists among Georgetown's citizens and governmental organizations"; and 2. Growth and Physical Development Policy 3.0 which states "Citizens, business owners and organizations enjoy the benefit of a well-planned community in which conflicting needs are balanced"; and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan. SECTION 2. Exhibits A and B relating to the addition of regulations regarding park land dedication zones and lots on cul-de-sacs in rural subdivisions are hereby adopted by the City Council of the City of Georgetown, Texas, SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. Any person(s) or firm or corporation who shall violate any provision of this ordinance, or shall fail to comply therewith, shall be deemed guilty of a Class C misdemeanor, and upon conviction thereof, shall be punishable. Each day a violation shall continue shall be deemed to be a separate offense to the maximum fine allowed by State law for Class C misdemeanors. SECTION 6. The City Council hereby declares that this Ordinance should be adopted on emergency passage. This ordinance shall become effective and be in full force and effect in ten (10) days on and after publication in accordance with the provisions of the Charter of the City of Georgetown. The primary zone for a subdivision located within morethan one (1) zone shall be each zone that the subdivision is located within. An owner, subdivider, or applicant for a subdivision may authorize the expenditure of the park dedication fees for that subdivision in zones other than those defined as primary or secondary with the recommendation of the Board and the approval of the Council. All Park Fund money collected prior to the adoption of this section shall be expended according to these requirements. Review of the park dedication zones shall be conducted during each review of the Subdivision Regulations. Table 42090 C. By dedication within the plat to be filed for record in the office of the County Clerk of Williamson County, Texas. B. By warranty deed transferring the property in fee simple to the City of Georgetown, Texas. In any event, land must be free and clear of any mortgages or liens at the time of such dedication or conveyance. 40000-109 Revised 2/98 EXHIBIT A Figure 420900 - Park Dedication Zones EXHIBIT B PROPOSED AUGUST 1999 REVISIONS TO THE GEORGETOWN SUBDIVISION REGULATIONS Key: Underlined words denote additions to the regulations. Section 36050 Lots All lots in rural subdivisions shall: A. Be a minimum of one (1) acre in size; and B. Have a minimum width at the front property line of one hundred and twenty (120) feet, excMt on cul-de-sacs, which may have a minimum width of 85 feet at the front property line, provided a 50 foot setback is established and the 120 foot lot width is achieved at the 50 foot front setback; and C. Be designed so that all access is provided from a local street and in no case shall access be permitted from a major thoroughfare or street; State Highway, farm to market road or ranch road; or numbered County roadway.
