WHEREAS, the cliff area at Blue Hole Park is now owned by the City of Georgetown,
WHEREAS, the cliff area at Blue Hole Park presents a clear danger to all visitors of the park;
WHEREAS, in order to ensure the safety of the general public, it is necessary to prohibit the
diving or jumping from the cliffs at Blue Hole Park or the causing of one to dive or jump from the
cliffs;
WHEREAS, signs may be posted informing the public of the requirements of this ordinance;
WHEREAS, a home rule municipality may pass and enforce ordinances necessary to protect
health, life, and property and to preserve the good government, order, and security of the municipality
and its inhabitants;
WHEREAS, in order to protect the health and welfare of all residents within the City of
Georgetown, the City Council has found it necessary to adopt this ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
GEORGETOWN, TEXAS, THAT:
SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby
found and declared to be true and correct, and are incorporated by reference herein and expressly
made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance
implements Facilities and Services Policy 4.0 which states "The City provides for the safety of its
citizens and supports the responsive delivery of coordinated services by the City and other public
agencies", and further finds that the enactment of this ordinance is not inconsistent or in conflict with
any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the
Policy Plan.

SECTION 2. Section 12.20.080 is hereby added to Chapter 12.20 of the Code of Ordinances
of the City of Georgetown, Texas to read as follows:
"12.20.080 Jumping or Diving From Cliff at Blue Hole Park.
A. It is unlawful for any person to dive or jump from any cliff or rock face
in Blue Hole Park.
B. It is unlawful to knowingly, recklessly, or with criminal negligence cause
any person to dive, jump, or fall from any cliff or rock face in Blue Hole
Park."
SECTION 3. Any person violating any provision of this ordinance is deemed guilty of a
misdemeanor, and upon conviction thereof, shall be punished by a fine in accordance with the
provisions of Section 1.08.010 of the Code of Ordinances for the City of Georgetown. Each and
every violation shall constitute a separate offense.
SECTION 4. All ordinances and resolutions, or parts of ordinances and resolutions, in
conflict with this Ordinance are hereby repealed, and are no longer of any force and effect.
SECTION 5. If any provision of this ordinance or application thereof to any person or
circumstance, shall be held invalid, such invalidity shall not affect the other provisions or application
thereof, of this ordinance which can be given effect without the invalid provision or application, and
to this end the provisions of this ordinance are hereby declared to be severable.
SECTION 6. The Mayor is hereby authorized to sign this ordinance and the City Secretary
to attest. This ordinance shall become effective and be in full force and effect (10) ten days on and
after publication in accordance with the provisions of the Charter of the City of Georgetown.
