HomeMy WebLinkAboutORD 99-34-A - Canvassing Results ElectionAN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE CITY OF GEORGETOWN GENERAL RUNOFF ELECTION HELD ON MAY 29, 1999; AND PROVIDING FOR EMERGENCY PASSAGE WHEREAS, the City Council of the City of Georgetown, Texas ordered a General Election to be held on Saturday, May 1, 1999 for the purpose of the following: WHEREAS, in the Mayor's contest, no one candidate received a clear majority of the votes cast for Mayor in the General Election; and WHEREAS, a Runoff Election was held on May 29, 1999. WHEREAS, it appears from the results of the Runoff Election, duly and legally made, that each of the candidates received the following votes: MaryEllen Kersch Leo Wood AN 3 WHEREAS, the City Council of the City of Georgetown has determined that this Ordinance must be passed on an emergency reading to allow the Mayor to take office in a timely manner, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN TEXAS, that: SECTION I. The City Council officially finds and determines that said election was duly called; that proper notice of said election was given in accordance with law; that said election was held in accordance with law; and that returns of the results of said election have been made and delivered, and that the City Council has canvassed said returns, all in accordance with the law and the Ordinance calling said election. SECTION II. The City Council officially finds and determines that , /xva was elected as Mayor. 1999 Runoff Election Ordinance No. 10:43444 '" Page 1 of 2 Pages Furthermore, said parry is hereby declared duly elected to said respective office, subject to the taking of an oath of office as provided for by the laws of the State of Texas and the Charter of the City of Georgetown, Texas, SECTION III It is further found and determined that in accordance with the order of this governing body, the City Secretary posted written notice of the date, place and subject of this meeting on the bulletin board located outside of City Hall/Council Chambers, a place convenient and readily accessible to the general public, and said notice having been so posted and remaining posted continuously for at least 72 hours preceding the scheduled time of said meeting. A copy of the return of said posting shall be attached to the minutes of this meeting and shall be made a part thereof for all intents and purposes. SECTION IV. This Ordinance establishes an emergency due to the need for the Mayor to take office in a timely fashion and in accordance with the provisions of the Election Code of the State of Texas and the Charter of the City of Georgetown, and therefore this ordinance shall take effect immediately upon passage by a favorable vote of not less than a majority plus one of the Councilmembers qualified in serving.
