WHEREAS, The City Council recognizes the need for continuity of traffic in the City Of Georgetown; and WHEREAS, The City Council finds that Gated Communities are not in keeping with the City of Georgetown's vision of community; and WHEREAS, The City Council acknowledges the value of uninterrupted response of emergency vehicles to the needs of the citizens of Georgetown NOW, THEREFORE, B E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GEORGETOWN, SECTION 1. The facts and recitations contained in the preamble of this ordinance are hereby found and declared to be true and correct, and are incorporated by reference herein and expressly made a part hereof, as if copied verbatim. The City Council hereby finds that this ordinance implements The Growth And Physical Development , Policy 7 of the Century Plan Policy Plan Element, which states: "GEORGETOWN'S LAND USES SUPPORT ECONOMIC, CULTURAL AND SOCIAL ACTIVITIES FOR ALL RESIDENTS, BUSINESSES AND ORGANIZATIONS; AND THE CITY'S DEVELOPMENT PROCESS ENCOURAGES NEW AND INFILL DEVELOPMENT", The Transportation, Policy 12 of the Century Plan Policy Plan Element, which states "GEORGETOWN'S TRANSPORTATION SYSTEM PROVIDES FOR THE SAFE AND EFFECIENT MOVEMENT OF TRAFFIC, PROMOTES THE ECONOMIC INTERESTS OF THE COMMUNITY, AND ADEQUATELY SERVES THE NEEDS OF INDIVIDUALS", and the Urban Design, Policy 13 of the Century Plan Policy Plan Element, which states, "GEORGETOWN HAS A POSITIVE, IDENTIFIABLE IMAGE AND AN ATTRACTIVE APPEARANCE", and further finds that the enactment of this ordinance is not inconsistent or in conflict with any other Century Plan Policies, as required by Section 2.03 of the Administrative Chapter of the Policy Plan, SECTION 2. Section 8.04.065 of the Code of Ordinances of the City of Georgetown, Texas is hereby added to read as follows: 8.04.065 GATED AREAS AND COMMUNITIES x Chapter 6 of the Fire Prevention Code adopted in this chapter is amended by adding thereto section 602.6.5.1 as follows: Excepting individual single-family residences, Gates or other barriers that restrict access to areas of residential usage are prohibited, including, but not limited to, subdivisions, apartments, rooming houses, dormitories, hotels motels, or any structure used as a domicile or for sleeping purposes. Gates or restricted access to areas of commercial or industrial use, shall be permitted if it is determined by the authority having jurisdiction that, it poses no threat to the occupants of the area to be gated, or to the responders in the event of an emergency. SECTION 3. All ordinances and resolutions, or parts of ordinances and resolutions, in conflict with this Ordinance are hereby repealed, including Subdivision Regulations of The City Of Georgtown, Texas, Chapter 33000, Section 33030, Paragraph R, pertaining to private streets, and are no longer of any force and effect. SECTION 4. If any provision of this ordinance or application thereof to any person or circumstance, shall be held invalid, such invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are hereby declared to be severable. SECTION 5. The Mayor is hereby authorized to sign this ordinance and the City Secretary to attest. This ordinance shall become effective and be in full force and effect in (10) ten days on and after publication in accordance with the provisions of the Charter of the City of Georgetown.
